                   A  BILL  FOR  AN  ACT

RELATING TO THE CORRECTIONAL HEALTH CARE ADMINISTRATOR.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that providing for the
 
 2 health care needs of inmates is a priority for the department of
 
 3 public safety.  As inmates are wards of the State, the courts
 
 4 have established that health services in correctional facilities
 
 5 must be maintained at the level of standards for health care
 
 6 consistent with that found in the community.  This responsibility
 
 7 is a great one and requires a program administrator who is not
 
 8 only an expert in the profession, but who also understands the
 
 9 unique aspects of delivering health care services in a
 
10 correctional environment.
 
11      The purpose of this Act is to allow the department of public
 
12 safety to hire a program administrator based on specialized
 
13 abilities and to provide that the program administrator shall be
 
14 exempt from the civil service process.
 
15      SECTION 2.  Chapter 353C, Hawaii Revised Statutes, is
 
16 amended by adding a new section to be appropriately designated
 
17 and to read as follows:
 
18      "353C-     Correctional health care administrator.  The
 
19 department may establish a permanent exempt position known as the

 1 correctional health care administrator for the purpose of
 
 2 administering the correctional health care program of the
 
 3 department.  The correctional health care administrator shall be
 
 4 appointed by the director and be exempted from chapter 76 and
 
 5 77."
 
 6      SECTION 3.  New statutory material is underscored.
 
 7      SECTION 4.  This Act shall take effect upon its approval.
