DESCRIPTION:
Permits the holder of a Type 3 driver's license to drive a motor
vehicle with a gross vehicle weight rating of up to 15,000 pounds
and the holder of a Type 4 license to drive a motor vehicle with

                   A  BILL  FOR  AN  ACT

RELATING TO MOTOR VEHICLES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that motor vehicle
 
 2 configurations and manufacturing have improved and heavier motor
 
 3 vehicles are designed to more safely carry the loads being
 
 4 demanded of them.
 
 5      The purpose of this Act is to permit the holder of a Type 3
 
 6 driver's license to drive a motor vehicle with a gross vehicle
 
 7 weight rating of up to 15,000 pounds, although currently limited
 
 8 to 11,000 pounds, and the holder of a Type 4 license to drive a
 
 9 motor vehicle with a gross vehicle weight rating of 15,001 to
 
10 26,000 pounds, although currently 11,001 to 26,000 pounds.
 
11      SECTION 2.  Section 286-102, Hawaii Revised Statutes, is
 
12 amended by amending subsection (b) to read as follows:
 
13      "(b)  A person operating the following category or
 
14 combination of categories of motor vehicles shall be examined as
 
15 provided in section 286-108 and duly licensed by the examiner of
 
16 drivers:
 
17      (1)  Motor scooters;
 
18      (2)  Motorcycles and motor scooters;
 
19      (3)  Passenger cars of any gross vehicle weight rating,

 1           buses designed to transport fifteen or fewer occupants,
 
 2           and trucks and vans having a gross vehicle weight
 
 3           rating of [eleven] fifteen thousand pounds or less; and
 
 4      (4)  All of the motor vehicles in category (3) and trucks
 
 5           having a gross vehicle weight rating of [eleven]
 
 6           fifteen thousand one through twenty-six thousand
 
 7           pounds.
 
 8      A school bus or van operator shall be properly licensed to
 
 9 operate the category of vehicles that the operator operates as a
 
10 school bus or van and shall comply with the standards of the
 
11 department of transportation as provided by rules adopted
 
12 pursuant to section 286-181."
 
13      SECTION 3.  This Act does not affect rights and duties that
 
14 matured, penalties that were incurred, and proceedings that were
 
15 begun before its effective date.
 
16      SECTION 4.  Statutory material to be repealed is bracketed.
 
17 New statutory material is underscored.
 
18      SECTION 5.  This Act shall take effect upon its approval.
