Airport Landing Fees Rebate


DESCRIPTION:
Provides for the rebate of airport landing fees, after the close
of the fiscal year, if fund balance plus projected future
revenues exceed the amount determined to be necessary to finance

                   A  BILL  FOR  AN  ACT

RELATING TO AIRPORT LANDING FEES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 261-5, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  Except for that portion of the payments received by
 
 4 the department under a contract entered into as authorized by
 
 5 section 261-7 and deposited in the transportation use special
 
 6 fund pursuant to section 261D-1, all moneys received by the
 
 7 department from rents, fees, and other charges collected pursuant
 
 8 to this chapter, as well as all aviation fuel taxes paid pursuant
 
 9 to section 243-4(a)(2), shall be paid into the airport revenue
 
10 fund created by section 248-8.
 
11      All moneys paid into the airport revenue fund shall be
 
12 appropriated, applied, or expended by the department for any
 
13 purpose within the jurisdiction, powers, duties, and functions of
 
14 the department related to the statewide system of airports,
 
15 including, without limitation, the costs of operation,
 
16 maintenance, and repair of the statewide system of airports and
 
17 reserves therefor, and acquisitions (including real property and
 
18 interests therein), constructions, additions, expansions,
 
19 improvements, renewals, replacements, reconstruction,

 1 engineering, investigation, and planning for the statewide system
 
 2 of airports, all or any of which in the judgment of the
 
 3 department are necessary to the performance of its duties or
 
 4 functions.  The department shall generate sufficient revenues
 
 5 from its airport properties to meet all of the expenditures of
 
 6 the statewide system of airports and to comply with section
 
 7 39-61; provided that [as]:
 
 8      (1) As long as sufficient revenues are generated to meet
 
 9          such expenditures, the director of transportation may,
 
10          in the director's discretion, grant a rebate of the
 
11          aviation fuel taxes paid into the airport revenue fund
 
12          during a fiscal year pursuant to sections 243-4(a)(2)
 
13          and 248-8 to any person who has paid airport use charges
 
14          or landing fees during such fiscal year.  Such rebate
 
15          may be granted during the next succeeding fiscal year
 
16          but shall not exceed one-half cent per gallon per
 
17          person, and shall be computed on the total number of
 
18          gallons for which the tax was paid by such person, for
 
19          such fiscal year[.]; and
 
20      (2) If after the close of the fiscal year, the airport
 
21          revenue fund balance plus projected future revenues
 
22          exceed the amount determined to be necessary to finance
 
23          the fund requirements, which includes operating expenses
 
24          and debt service, the director of transportation may, in
 
25          the director's discretion, grant a rebate of the airport
 
26          landing fees."

 1      SECTION 2.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 3.  This Act shall take effect upon its approval.
