Proposes an amendment to the State Constitution to add a member
of the armed forces as a nonvoting member of the BOE appointed by
the governor.  Requires the governor to select from a list of
three candidates submitted by the highest ranking senior military

                   A  BILL  FOR  AN  ACT

PROPOSING AN AMENDMENT TO ARTICLE X, SECTION 2, OF THE HAWAII
   CONSTITUTION, TO CHANGE THE COMPOSITION OF THE BOARD OF
   EDUCATION.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to propose an
 
 2 amendment to article X, section 2, of the Constitution of the
 
 3 State of Hawaii to add a member of the armed forces as a
 
 4 nonvoting member to the board of education.  The new nonvoting
 
 5 member shall be appointed by the governor.
 
 6      SECTION 2.  Article X, section 2, of the Constitution of the
 
 7 State of Hawaii is amended to read as follows:
 
 8                        "BOARD OF EDUCATION
 
 9      Section 2.  There shall be a board of education composed of
 
10 members who shall be elected in a nonpartisan manner by qualified
 
11 voters, as provided by law, from two at-large school board
 
12 districts.  The first school board district shall be [comprised]
 
13 composed of the island of Oahu and all other islands not
 
14 specifically enumerated.  The second school board district shall
 
15 be [comprised] composed of the islands of Hawaii, Maui, Lanai,
 
16 Molokai, Kahoolawe, Kauai and Niihau.  Each at-large school board
 
17 district shall be divided into departmental school districts, as
 
18 may be provided by law.  There shall be at least one member
 
19 residing in each departmental school district.  The Hawaii State

 1 Student Council shall select a public high school student to
 
 2 serve as a nonvoting member on the board of education.  The
 
 3 governor shall select a member of the armed forces, from a list
 
 4 of three candidates submitted by the highest ranking senior
 
 5 military officer in Hawaii, to serve as a nonvoting member of the
 
 6 board of education."
 
 7      SECTION 3.  The question to be printed on the ballot shall
 
 8 be as follows:
 
 9      "Shall the governor authorize a member of the armed forces
 
10      as a nonvoting member of the board of education?"
 
11      SECTION 4.  Constitutional material to be repealed is
 
12 bracketed.  New constitutional material is underscored.
 
13      SECTION 5.  This amendment shall take effect upon compliance
 
14 with article XVII, section 3, of the Constitution of the State of
 
15 Hawaii.
