                   A  BILL  FOR  AN  ACT

RELATING TO THE STATEWIDE TRAFFIC CODE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 291C-72, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  When traffic-control signals are not in place or not
 
 4 in operation, the driver of a vehicle shall [yield the right of
 
 5 way, slowing down or stopping if need be to so yield,] slow down
 
 6 and stop to yield to a pedestrian crossing the roadway within a
 
 7 crosswalk [when the pedestrian is upon the half of the roadway
 
 8 upon which the vehicle is traveling, or when the pedestrian is
 
 9 approaching so closely from the opposite half of the roadway as
 
10 to be in danger.] regardless of which half of the roadway the
 
11 pedestrian is upon; provided that the driver shall slow down and
 
12 stop for a pedestrian within a crosswalk on a multilane roadway
 
13 with a raised center medial only when the pedestrian is upon the
 
14 half of the roadway upon which the vehicle is traveling."
 
15      SECTION 2.  Statutory material to be repealed is bracketed.
 
16 New statutory material is underscored.
 
17      SECTION 3.  This Act shall take effect upon its approval.
