                   A  BILL  FOR  AN  ACT

RELATING TO PROFESSIONAL SERVICES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 103D, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to part X to be appropriately
 
 3 designated and to read as follows:
 
 4      "�103D-    Professional services.  (a)  In any expenditure
 
 5 of public funds for the performance of professional services as
 
 6 defined in section 103D-104, the use of a Hawaii professional
 
 7 services business shall be preferred.  Where a package bid or
 
 8 response to a request for proposal contains both Hawaii and non-
 
 9 Hawaii professional services businesses, then for the purpose of
 
10 selecting the lowest bid or purchase price only, the bid or offer
 
11 by a non-Hawaii professional services business shall be increased
 
12 by a preference percentage pursuant to rules adopted by the
 
13 policy board.
 
14      (b)  This section shall not apply when precluded by federal
 
15 requirements for competitive bidding."
 
16      SECTION 2.  Section 103D-1001, Hawaii Revised Statutes, is
 
17 amended by adding a new definition to be appropriately inserted
 
18 and to read as follows:
 
19      ""Hawaii professional services business" means any person,

 1 agency, corporation, or other business entity with its principal
 
 2 place of business or ancillary headquarters located in the State
 
 3 and that proposes to obtain eighty per cent of the labor for the
 
 4 performance of professional services from persons domiciled in
 
 5 Hawaii."
 
 6      SECTION 3.  New statutory material is underscored.
 
 7      SECTION 4.  This Act shall take effect upon its approval.
