                   A  BILL  FOR  AN  ACT
AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS AND MAKING
   AN APPROPRIATION FOR THE DEPARTMENT OF ACCOUNTING AND
   GENERAL SERVICES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that many of Hawaii's
 
 2 public schools have old and unsafe playground equipment.  New
 
 3 federal guidelines covering the safety of playground equipment
 
 4 have caused many elementary schools to remove or place off limits
 
 5 aging swings, merry-go-rounds, and jungle gyms that fail to meet
 
 6 the new federal standards.  Beyond replacing unsafe equipment,
 
 7 new playgrounds also are required to be accessible to disabled
 
 8 students and include padding on the ground to cushion falls.
 
 9      Most public elementary schools in Hawaii have safety
 
10 problems with some playground equipment.  Nationally, almost
 
11 200,000 schoolchildren are injured each year on unsafe playground
 
12 equipment, and as many as twenty students are fatally injured.
 
13      The legislature finds that the health and well-being of all
 
14 of our schoolchildren requires the prompt removal of unsafe
 
15 playground equipment from our school playgrounds, and the
 
16 installation of new equipment that meets the federal safety
 
17 guidelines and includes ground padding to cushion falls.
 
18      It is the purpose of this Act to authorize the issuance of
 
19 general obligations bonds and make an appropriation for the

 1 purchase of safe playground equipment for public schools.
 
 2      SECTION 2.  The director of finance is authorized to issue
 
 3 general obligation bonds in the sum of $12,000,000, or so much
 
 4 thereof as may be necessary, and the same sum, or so much thereof
 
 5 as may be necessary, is appropriated for fiscal year 2000-2001,
 
 6 for the purpose of purchasing new and replacement playground
 
 7 equipment for public schools.  Expenditure priority shall be
 
 8 given to older schools with unsafe equipment; those schools with
 
 9 equipment open to public use after school hours and on weekends;
 
10 and schools that demonstrate a community contribution of time
 
11 and/or money.
 
12      SECTION 3.  The appropriations made for the purpose
 
13 authorized in this Act shall not lapse at the end of the fiscal
 
14 biennium for which the appropriation is made; provided that all
 
15 appropriations which are unencumbered as of June 30, 2003, shall
 
16 lapse as of that date.
 
17      SECTION 4.  The sum appropriated shall be expended by the
 
18 department of accounting and general services for the purposes of
 
19 this Act.
 
20      SECTION 5.  This Act shall take effect on July 1, 2000.
