                   A  BILL  FOR  AN  ACT

ESTABLISHING A COMMISSION TO CELEBRATE THE ONE-HUNDREDTH
   ANNIVERSARY OF THE ARRIVAL OF THE KOREANS TO HAWAII.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that members of the Korean
 
 2 community have contributed significantly and substantially to
 
 3 Hawaii.  Since the arrival of the first Koreans to Hawaii in
 
 4 1903, the rich culture and proud heritage of the Korean people
 
 5 have been and continues to be a positive influence upon life in
 
 6 Hawaii.  The year 2003 will mark the one-hundredth anniversary of
 
 7 their arrival in Hawaii.  In recognition of the great
 
 8 contributions of Koreans to our diverse and multicultural
 
 9 society, a celebration to commemorate their arrival and
 
10 subsequent achievements in Hawaii is appropriate.  
 
11      The purpose of this Act is to provide for the celebration of
 
12 the centennial anniversary of the Korean people in Hawaii.
 
13      SECTION 2.  Creation of the Korean centennial celebration
 
14 commission.  There is established a temporary commission to be
 
15 known as the Korean centennial celebration commission which shall
 
16 have charge of all arrangements for the commemoration of the
 
17 centennial anniversary of the arrival of the first Koreans to
 
18 Hawaii.  The commission shall be placed within the office of the
 
19 governor for administrative purposes and shall cease to operate
 
20 after December 31, 2003.

 1      The centennial celebration shall be immune from civil
 
 2 liability that may occur in the implementation of the
 
 3 celebration.
 
 4      SECTION 3.  Membership, compensation.  The commission shall
 
 5 consist of fifteen members of the Korean community to be
 
 6 appointed by the governor without regard to section 26-34, Hawaii
 
 7 Revised Statutes.  The members shall represent government, labor,
 
 8 business, culture and the arts, and the community at large.  The
 
 9 governor shall designate the chair of the commission from among
 
10 the appointed members.  An individual appointed to another
 
11 commission is eligible to be appointed as a member of this
 
12 commission.   
 
13      The members shall not receive compensation for their
 
14 services but shall be reimbursed for necessary expenses,
 
15 including travel expenses, incurred in the performance of their
 
16 duties under this Act
 
17      Any member of the commission shall be immune from civil
 
18 liability for any act done in connection with the performance of
 
19 their duties as provided in section 26-35.5, Hawaii Revised
 
20 Statutes.
 
21      SECTION 4.  Powers and duties.  The commission shall prepare
 
22 an overall program to celebrate the centennial anniversary of the
 
23 arrival of the Korean people in Hawaii, their significant
 
24 contributions to the development of this State, and their culture

 1 and heritage.  The commission shall identify a non-profit
 
 2 organization that will be responsible for any moneys received or
 
 3 expended for the centennial anniversary celebration.  The
 
 4 commission shall develop, plan, and coordinate the various
 
 5 program activities that are to be scheduled throughout the year
 
 6 of the celebration and shall encourage the participation of all
 
 7 segments of the Korean community.  In fulfilling its
 
 8 responsibilities, the commission shall consult, cooperate with,
 
 9 and seek advice from appropriate Korean organizations and
 
10 agencies.
 
11      The commission shall submit to the governor a comprehensive
 
12 report for the centennial anniversary celebration which shall
 
13 include a description of:
 
14      (1)  The production, publication, and distribution of books,
 
15           films, and other educational materials on the life and
 
16           experiences of Koreans in Hawaii;
 
17      (2)  Conferences, convocations, lectures, and seminars; and
 
18      (3)  Traveling exhibits, other exhibits, ceremonies,
 
19           theatrical productions, and other special events
 
20           commemorating the anniversary.
 
21      SECTION 5.  Financing.  The commission may seek grants from
 
22 public and private sources and may accept donations to finance
 
23 the projects, programs, and activities of the centennial
 
24 anniversary celebration.  Any funds received by the commission

 1 shall be turned over to the non-profit organization responsible
 
 2 for any moneys received or expended for the centennial
 
 3 anniversary celebration.
 
 4      The provisions of Chapter 42F, Hawaii Revised Statutes,
 
 5 shall not apply to any grant or subsidy made pursuant to this Act
 
 6 by the legislature.
 
 7      All property acquired by the commission shall be deposited
 
 8 for preservation in the state library system, museums, and public
 
 9 archives or shall otherwise be disposed of as directed by the
 
10 commission.
 
11      SECTION 6.  Final report.  At the end of its term, the
 
12 commission shall submit to the governor a final report of all its
 
13 activities, including an accounting of all moneys received and
 
14 disbursed.
 
15      SECTION 7.  This Act shall take effect on July 1, 2000.
