                   A  BILL  FOR  AN  ACT

MAKING AN EMERGENCY APPROPRIATION FOR THE DEPARTMENT OF
   ACCOUNTING AND GENERAL SERVICES, INFORMATION AND
   COMMUNICATION SERVICES DIVISION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  This Act is recommended by the governor for
 
 2 immediate passage in accordance with section 9 of article VII of
 
 3 the Constitution of the State of Hawaii.
 
 4      SECTION 2.  Although general funds were appropriated for the
 
 5 information processing services program for the period beginning
 
 6 July 1, 1999, through June 30, 2000, a critical funding emergency
 
 7 exists.  In order to address an over collection of federal
 
 8 reimbursements during fiscal years 1996-1997 and 1997-1998, the
 
 9 billing of federal-funded programs for information technology
 
10 services by the information and communication services division
 
11 will be limited in fiscal year 1999-2000.  As a result of this
 
12 reduction in revenues and due to increased operating expenses,
 
13 the program will realize an operating budget deficit of $800,000
 
14 in fiscal year 1999-2000.  To meet the existing fiscal
 
15 obligations required to provide continued information processing
 
16 services for state agencies, the program will spend all available
 
17 funds prior to the end of the current fiscal year.
 
18      The purpose of this Act is to appropriate funds to address

 1 the budget deficit while preventing the deletion of selected
 
 2 statewide information technology services.
 
 3      SECTION 3.  There is appropriated out of the general
 
 4 revenues of the State of Hawaii the sum of $800,000 or so much
 
 5 thereof as may be necessary for fiscal year 1999-2000 to be used
 
 6 in support of the State's information processing services
 
 7 program.
 
 8      SECTION 4.  The sum appropriated shall be expended by the
 
 9 department of accounting and general services for the purposes of
 
10 this Act.
 
11      SECTION 5.  The department of accounting and general
 
12 services shall pursue action against the consultant who made the
 
13 over-collection and hold the consultant accountable for the
 
14 resulting loss.  The department shall report to the legislature
 
15 no later than twenty days before the regular session of 2001, on
 
16 the action taken and results.
 
17      SECTION 6.  This Act shall take effect upon its approval.
