                   A  BILL  FOR  AN  ACT

RELATING TO TRAFFIC ACCIDENTS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The purpose of this Act is to ensure that Hawaii
 
 2 courts accept computer analysis of conventional and electronic
 
 3 photographs to determine locations, distances, and dimensions of
 
 4 physical evidence at the scene of Hawaii highway traffic
 
 5 accidents.  It is the legislature's policy to encourage off-site
 
 6 computer analysis of photographs, in place of on-site
 
 7 measurements of physical evidence, to reduce the duration of lane
 
 8 closures for police investigation of serious traffic accidents.
 
 9 The legislature finds that lane closures for and "rubbernecking"
 
10 next to police investigations can cause significant traffic
 
11 delays and may result in secondary traffic accidents.
 
12      SECTION 2.  Chapter 286, Hawaii Revised Statutes, is amended
 
13 by adding a new section to be appropriately designated and to
 
14 read as follows:
 
15      "�286-    Investigation of highway traffic accidents.
 
16 Measurements derived for police investigation of a highway
 
17 traffic accident from computer analysis of photographs or
 
18 electronic pictures of the scene of the accident, recorded by a
 
19 conventional, video, or digital camera, shall be prima facie

 1 evidence of the location, orientation, and dimensions of and
 
 2 distances between physical evidence at the scene of the
 
 3 accident."
 
 4      SECTION 3.  Statutory material to be repealed is bracketed.
 
 5 New statutory material is underscored.
 
 6      SECTION 4.  This Act shall take effect upon its approval.
