                   A  BILL  FOR  AN  ACT

RELATING TO OFFICE OF HAWAIIAN AFFAIRS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 13D-3, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�13D-3 Qualifications of voters; registration.(a)  Every
 
 4 person who registers as required by law shall be entitled to vote
 
 5 at any election of board members provided that the person shall
 
 6 have attained the age of eighteen years at the time of the
 
 7 election.
 
 8      (b)  No person shall be eligible to register as a voter for
 
 9 the election of board members unless the person meets the
 
10 following qualifications:
 
11      (1)  The person is Hawaiian;
 
12      (2)  The person has attained the age of eighteen years or
 
13           will have attained such age within one year of the date
 
14           of the next election of board members; and
 
15      (3)  The person is otherwise qualified to register to vote
 
16           in the State[.]; provided that the person may be a non-
 
17           United States citizen for purposes of voting for the
 
18           election of board members only.
 
19      (c)  Any person eligible to and desiring to register as a

 1 voter for the election of board members shall go to any location
 
 2 designated by the clerk of the county, then and there to be
 
 3 examined under oath as to the person's qualifications as a voter.
 
 4 Each applicant shall make and subscribe to an application in the
 
 5 form of an affidavit as provided for under section 11-15.
 
 6      (d)  The clerk of each county shall register all persons in
 
 7 the county who are eligible to and desiring to register as voters
 
 8 for the election of board members.  The register may be
 
 9 maintained in conjunction with the general county register;
 
10 provided that the clerk shall be able to prepare a separate list
 
11 of voters for the election of board members, capable of
 
12 segregation by precinct and representative district.  The
 
13 maintenance, reproduction, and transmittal of records and
 
14 affidavits to a central file shall be in accordance with section
 
15 11-14.
 
16      [(e)  The clerk of each county shall amend the general
 
17 county register to include therein any person, who on November 6,
 
18 1984, was registered to vote only for members of the board of
 
19 trustees, to hereinafter be registered to vote in all elections
 
20 held in the State.]"
 
21      SECTION 2.  Statutory material to be repealed is bracketed.
 
22 New statutory material is underscored.
 
23      SECTION 3.  This Act shall take effect upon its approval.
