                   A  BILL  FOR  AN  ACT

RELATING TO TRANSIENT ACCOMMODATIONS TAX.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that amendments to chapter
 
 2 237D are needed to ensure adequate funding of land acquisition
 
 3 for coastal and open space resources.  The legislature finds that
 
 4 the best means of ensuring a healthy economy is to protect the
 
 5 environment which tourists come to see.  Acquiring scenic coastal
 
 6 property, that is threatened with development, can help to secure
 
 7 the State's economic and environmental future.  Other states,
 
 8 such as Maryland and New Jersey, are spending nearly
 
 9 $1,000,000,000 on land acquisition to protect open space and
 
10 scenic resources.  Hawaii does not have any money in the land
 
11 acquisition fund at present.
 
12      SECTION 2.  Section 237D-6.5, Hawaii Revised Statutes, is
 
13 amended by amending subsection (b) to read as follows:
 
14      "(b)  Beginning on January 1, 1999[[],[]] revenues collected
 
15 under this chapter shall be distributed as follows:
 
16      (1)  17.3 per cent of the revenues collected under this
 
17           chapter shall be deposited into the convention center
 
18           capital and operations special fund established under
 
19           section 206X-10.5;

 1      (2)  [37.9] 18.95 per cent of the revenues collected under
 
 2           this chapter shall be deposited into the tourism
 
 3           special fund established under section 201B-11;
 
 4      (3)  18.95 per cent of the revenues collected under this
 
 5           chapter shall be deposited into the fund for the
 
 6           environment under section 173A-5;
 
 7      (4)  44.8 per cent of the revenues collected under this
 
 8           chapter shall be transferred as follows:  Kauai county
 
 9           shall receive 14.5 per cent, Hawaii county shall
 
10           receive 18.6 per cent, city and county of Honolulu
 
11           shall receive 44.1 per cent, and Maui county shall
 
12           receive 22.8 per cent.
 
13      All transient accommodations taxes shall be paid into the
 
14 state treasury each month within ten days after collection, and
 
15 shall be kept by the state director of finance in special
 
16 accounts for distribution as provided in this subsection."
 
17      SECTION 3.  Statutory material to be repealed is bracketed.
 
18 New statutory material is underscored.
 
19      SECTION 4.  This Act shall take effect on January 1, 2001.
