                   A BILL FOR AN ACT

RELATING TO HANAMAULU BAY, KAUAI.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Findings and purpose. The legislature finds

that by prohibiting fishing in certain areas, the ocean life

bounces back and corals and fish varieties return to healthy

levels over time. This has happened in Hanauma Bay on Oahu and

other areas on other islands. Some prohibitions have been

adopted by rule, as in the case of Hanamaulu Bay on Kauai.

The purpose of this Act is to displace these prohibitions

which give the department of land and natural resources the

controlling authority over Hanamaulu Bay and adopt a law that

prohibits certain fishing activities in Hanamaulu Bay and Ahukini

recreational pier, which is the public pier located in Hanamaulu

Bay.

SECTION 2. Chapter 188, Hawaii Revised Statutes, is amended

by adding a new section to part II, to be appropriately

designated and to read as follows:

"188- Hanamaulu Bay, Ahukini recreational pier,

prohibited activities. No person shall engage in the following

activities within Hanamaulu bay, located on the eastern portion

of the island of Kauai, or on the Ahukini recreational pier,
