Speeding; Constr. Sch. Zones

Requires tripling of fines for speeding in a school zone or
construction area.

                   A  BILL  FOR  AN  ACT



 1      SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is
 2 amended by adding a new section to be appropriately designated
 3 and to read as follows:
 4      "291C-    Speeding in a school zone or construction area.
 5 (a)  No person shall drive a motor vehicle at a speed greater
 6 than the maximum speed limit established pursuant to subsection
 7 (c) within a school zone or a construction area.
 8      (b)  Any person who violates this section shall be fined in
 9 an amount that is triple that of the applicable fine specified in
10 section 291C-161(b).
11      (c)  The director of transportation, pursuant to section
12 291C-102, shall place official signs in a school zone or a
13 construction area, establishing the maximum speed limits.
14      (d)  For purposes of this section, the term "construction
15 area" includes but is not limited to any area in which there is
16 occurring the installation and construction of connections for
17 streets, roads, driveways, concrete curbs and sidewalks,
18 structures, drainage systems, landscaping or grading within the
19 highway rights-of-way, excavation and backfilling of trenches or

 1 other openings in state highways, the restoration, replacement,
 2 or repair of the base course, pavement surfaces, highway
 3 structures, or any other highway improvements."
 4      SECTION 2.  Section 291C-161, Hawaii Revised Statutes, is
 5 amended by amending subsection (b) to read as follows:
 6      "(b)  Except as provided in subsection (c) every person who
 7 violates any provision of this chapter for which another penalty
 8 is not provided shall be fined:
 9      (1)  Not more than $200 for a first conviction thereof;
10      (2)  Not more than $300 for conviction of a second offense
11           committed within one year after the date of the first
12           offense; and
13      (3)  Not more than $500 for conviction of a third or
14           subsequent offense committed within one year after the
15           date of the first offense;
16 provided that upon a conviction for a violation of section
17 291C-12, 291C-12.5, 291C-12.6, [or] 291C-95, or 291C-  , the
18 person shall be sentenced in accordance with that section."
19      SECTION 3.  This Act does not affect rights and duties that
20 matured, penalties that were incurred, and proceedings that were
21 begun, before its effective date.
22      SECTION 4.  Statutory material to be repealed is bracketed.
23 New statutory material is underscored.
