DESCRIPTION:
Establishes fines for motorists who are convicted of driving
their motor vehicles at speeds greater than the maximum speed

                   A  BILL  FOR  AN  ACT

RELATING TO SPEEDING.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is
 
 2 amended by adding a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�291C-    Speeding in a school zone or construction area.
 
 5 (a)  No person shall drive a motor vehicle at a speed greater
 
 6 than the maximum speed limit established pursuant to subsection
 
 7 (b) within a school zone or a construction area.
 
 8      (b)  Notwithstanding section 291C-102, the director of
 
 9 transportation shall establish maximum speed limits for school
 
10 zones and construction areas and place official signs in these
 
11 zones and areas.
 
12      (c)  Any person who violates this section shall be fined:
 
13      (1)  Not more than $400 for a first conviction thereof;
 
14      (2)  Not more than $600 for conviction of a second offense
 
15           committed within one year after the date of the first
 
16           offense; and
 
17      (3)  Not more than $1,000 for conviction of a third or
 
18           subsequent offense committed within one year after the
 
19           date of the first offense.

 1      (d)  For purposes of this section, the term "construction
 
 2 area" includes any area in which there is occurring the
 
 3 installation and construction of connections for streets, roads,
 
 4 driveways, concrete curbs and sidewalks, structures, drainage
 
 5 systems, landscaping or grading within the highway rights-of-way,
 
 6 excavation and backfilling of trenches or other openings in state
 
 7 highways, the restoration, replacement, or repair of the base
 
 8 course, pavement surfaces, highway structures, or any other
 
 9 highway improvements."
 
10      SECTION 2.  This Act does not affect rights and duties that
 
11 matured, penalties that were incurred, and proceedings that were
 
12 begun, before its effective date.
 
13      SECTION 3.  Statutory material to be repealed is bracketed.
 
14 New statutory material is underscored.
 
15      SECTION 4.  This Act shall take effect upon its approval.
