                   A  BILL  FOR  AN  ACT

RELATING TO INFORMATION PRACTICES. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 92F, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "92F-    Informational practices special fund.
 
 5      (a)  There is established in the state treasury, the
 
 6           informational practices special fund, into which shall
 
 7           be deposited revenue derived from all fees charged for
 
 8           any and all training programs, materials, and
 
 9           publications provided by the office of information
 
10           practices.  The office of information practices shall
 
11           use the moneys in the informational practices special
 
12           fund to:
 
13           (1)  Create, develop, maintain, and provide educational
 
14                opportunities, including materials, to government
 
15                agencies and members of the public; and
 
16           (2)  Assess administrative costs for the purposes of
 
17                this section.
 
18      (b)  The director shall approve the expenditures from the
 
19           informational practices special fund.  Expenditures

 1           shall be executed by the director or the director's
 
 2           designee.
 
 3      (c)  The informational pratices fund shall not be subject to
 
 4           section 36-27 and 36-30 relating to reimbursements to
 
 5           the state general fund.
 
 6      SECTION 2.  Section 92F-42, Hawaii Revised Statutes, is
 
 7 amended by adding two new subsections to read as follows:
 
 8     "(19) May provide education to government agencies and
 
 9           members of the public and may assess fees for such
 
10           education, training materials, and publications.  All
 
11           such fees collected shall be deposited into the
 
12           informational practices special fund.
 
13      (20) Shall adopt rules in accordance with chapter 91 to
 
14           establish reasonable fees for the purposes of this
 
15           chapter."
 
16      SECTION 3.  Chapter 323C, Hawaii Revised Statutes, is
 
17 amended by adding a new section to be appropriately designated
 
18 and to read as follows:
 
19      "�323C-    Health care information. (a)  There is
 
20 established a revolving fund in the state treasury to be
 
21 administered by the director of the office of information
 
22 practices and to be designated as the health care information
 
23 revolving fund.
 
24      (b)  The director may expend moneys from the health care

 1 information revolving fund for the regulation of health care
 
 2 information, including but not limited to, the hiring of
 
 3 professional, technical, support staff, and education.
 
 4      (c)  Beginning with fiscal year 2000-2001 and each fiscal
 
 5 year thereafter, each entity governed by chapter 323C, except
 
 6 government agencies shall deposit with the director by July 1, of
 
 7 each year an assessment based on a pro rata basis to be
 
 8 determined and imposed by the director.  The aggregate annual
 
 9 assessment shall not exceed $600,000.  The assessment shall be
 
10 credited to the health care information revolving fund.  
 
11      (d)  The director shall report annually to the legislature
 
12 before the covening of each regular session as to fund
 
13 administration and expenditures.  
 
14      (e)  The director may adopt rules in accordance with chapter
 
15 91 to effectuate the purposes of this section."
 
16      SECTION 4.  Upon approval of this Act, each entity described
 
17 in (c) above, shall pay to the director by September 30, 2000, a
 
18 one-time assessment in an amount not to exceed an aggregate
 
19 amount of $600,000, to be credited to the health care information
 
20 revolving fund.
 
21      SECTION 5.  There is appropriated out of the health care
 
22 information revolving fund the sum of $600,000, or so much
 
23 thereof as may be necessary for fiscal year 2001-2002, for the

 1 purposes of this Act.
 
 2      SECTION 6.  The sums appropriated shall be expended by the
 
 3 office of information practices for the purposes of this Act.
 
 4      SECTION 7.  New statutory material is underscored.
 
 5      SECTION 8.  This Act shall take effect upon its approval.
