False Identification

Creates a new felony for sale or manufacturer of deceptive
identification documents. (HB303 HD2)

                   A  BILL  FOR  AN  ACT



 1      SECTION 1.  Chapter 710, Hawaii Revised Statutes, is amended
 2 by adding a new section to be appropriately designated and to
 3 read as follows:
 4      "710-     Sale or manufacture of deceptive identification
 5 document; penalties.  (1)  A person commits the offense of sale
 6 or manufacture of deceptive identification document if the person
 7 intentionally or knowingly manufactures, offers for sale,
 8 furnishes, offers to furnish, transports, offers to transport,
 9 imports, or offers to import into this State, a deceptive
10 identification document unless there is printed the statement,
11 "NOT A GOVERNMENT DOCUMENT".  This statement shall be:
12      (a)  Printed diagonally in bold capital letters across the
13           face of the document;
14      (b)  Not less than one-eighth of an inch in height; and 
15      (c)  Printed conspicuously and permanently on the document
16           in permanent ink.
17      The name of the manufacturer shall also be printed
18 conspicuously and permanently on the document.

 1      (2)  A person who violates this section shall be guilty of a
 2 class C felony.
 3      (3)  Any property used or intended for use in the commission
 4 of, attempt to commit, or conspiracy to commit an offense under
 5 this section, or which facilitated or assisted such activity,
 6 shall be forfeited pursuant to chapter 712A.
 7      (4)  As used in this section, "deceptive identification
 8 document" means any document not issued by a governmental agency
 9 of this State or any political subdivision thereof, another
10 state, or the federal government, which purports to be, or which
11 might deceive a reasonable person into believing that it is a
12 document issued by such an agency, including but not limited to a
13 driver's license, identification card, birth certificate,
14 passport, or social security card."
15      SECTION 2.  This Act does not affect rights and duties that
16 matured, penalties that were incurred, and proceedings that were
17 begun before its effective date.
18      SECTION 3.  New statutory material is underscored.
19      SECTION 4.  This Act shall take effect upon its approval.
