DESCRIPTION:
To guarantee the timely return of assigned textbooks, provides
that students who fail to return or pay the replacement costs of
such books shall not be permitted to participate in co-curricular
activities or athletics until the outstanding obligation has been

                   A  BILL  FOR  AN  ACT

RELATING TO EDUCATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the failure of
 
 2 students to properly care for and return textbooks at the end of
 
 3 a course is a serious problem.  Every year, thousands of books
 
 4 are not returned at the end of the school year, creating textbook
 
 5 shortages that severely impact upon student learning and
 
 6 achievement.  A 1998 survey by the department of education
 
 7 revealed that two schools alone each lost more than 2,000
 
 8 textbooks during the 1996-1997 school year.  With the average
 
 9 cost of a textbook exceeding $40.00, such irresponsible behavior
 
10 by students cannot be allowed to continue.
 
11      The purpose of this Act is to hold students accountable for
 
12 returning their assigned textbooks upon the completion of a
 
13 course.  Students who fail to return or otherwise properly
 
14 account for their assigned textbooks at the end of a course shall
 
15 be denied participation in co-curricular and athletic activities
 
16 until their outstanding obligations have been cleared.
 
17      SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is
 
18 amended by adding a new section to be appropriately designated
 
19 and to read as follows:

 1      "�302A-     Participation in co-curricular and athletic
 
 2 activities.  (a)  In addition to any other penalties that may be
 
 3 imposed, any student who fails to return or pay the replacement
 
 4 cost of any assigned textbook shall not be permitted to
 
 5 participate in any co-curricular activity, including athletics,
 
 6 until the outstanding obligation has been cleared.
 
 7      (b)  The department shall adopt rules in accordance with
 
 8 chapter 91 to administer and implement this section."
 
 9      SECTION 3.  This Act does not affect rights and duties that
 
10 matured, penalties that were incurred, and proceedings that were
 
11 begun, before its effective date.
 
12      SECTION 4.  New statutory material is underscored.
 
13      SECTION 5.  This Act shall take effect upon its approval.
