                   A  BILL  FOR  AN  ACT
RELATING TO PRESCRIPTIVE AUTHORITY FOR ADVANCED PRACTICE
   REGISTERED NURSES.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  In 1994, the legislature passed a bill that
 
 2 granted prescriptive authority to advanced practice registered
 
 3 nurses and required the board of medical examiners to develop a
 
 4 formulary from which advanced practice registered nurses would
 
 5 prescribe.  The legislature finds that the final administrative
 
 6 rules regulating prescriptive authority, including an
 
 7 exclusionary formulary, will be adopted in October 1999.  The
 
 8 formulary includes a provision allowing each physician to
 
 9 determine the drugs or medications an advanced practice
 
10 registered nurse can prescribe.
 
11      As of 1999, forty-nine states and the District of Columbia
 
12 grant advanced practice registered nurses some degree of
 
13 prescriptive authority.  Of those states, thirty-seven states
 
14 authorize the prescribing of controlled substances by advanced
 
15 practice registered nurses.  Fewer than ten states require the
 
16 use of a formulary for prescribing by advanced practice
 
17 registered nurses.
 
18      The legislature finds that there is a continual need to
 
19 address issues regarding Hawaii residents' access to quality
 
20 health care services.  Advanced practice registered nurses and

 1 the services they provide are known to be safe, cost-effective,
 
 2 and of high quality.  The role of the advanced practice
 
 3 registered nurse and the primary health care services provided
 
 4 should be used and developed to the fullest extent possible.
 
 5      The purpose of this Act is to give advanced practice
 
 6 registered nurses greater ability to meet the primary health care
 
 7 needs of Hawaii's residents by:
 
 8      (1)  Granting advanced practice registered nurses authority
 
 9           to prescribe controlled substances in schedule II - V;
 
10           and
 
11      (2)  Eliminating the formulary requirement from which
 
12           advanced practice registered nurses can prescribe.
 
13      SECTION 2.  Section 457-8.6, Hawaii Revised Statutes, is
 
14 amended to read as follows:
 
15      "[[]�457-8.6[]]  Prescriptive authority for advanced
 
16 practice registered nurses.  The department of commerce and
 
17 consumer affairs shall grant prescriptive authority, including
 
18 controlled substances in schedule II - V, to advanced practice
 
19 registered nurses[; provided that the board of medical examiners
 
20 shall designate the applicable formularies; provided further that
 
21 the board of medical examiners shall submit an interim report on
 
22 the establishment of the formularies by December 31, 1994]."

 1      SECTION 3.  Statutory material to be repealed is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect upon its approval.
