employment or for admission to any public institution of higher

                   A  BILL  FOR  AN  ACT

RELATING TO COMPLIANCE WITH THE MILITARY SELECTIVE SERVICE ACT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that compliance with the
 
 2 United States Selective Service registration is vital to national
 
 3 security.  Hawaii's registration rate, however, ranks the lowest
 
 4 among the states in its region of the Selective Service System.
 
 5      A 1985 amendment to the federal Defense Authorization Bill
 
 6 requires Selective Service System registration for men required
 
 7 to register for appointment to federal jobs.  At least ten other
 
 8 states have passed legislation creating a parallel requirement
 
 9 that makes compliance with the Military Selective Service Act a
 
10 pre-condition for state employment.  The purpose of this Act is
 
11 to create a similar requirement in Hawaii, namely, to require
 
12 written verification of Selective Service registration for state
 
13 and county employment in order to encourage compliance.  In
 
14 addition, this Act further requires written verification of
 
15 Selective Service registration for admission to public
 
16 institutions of higher education as an additional inducement to
 
17 register with the Selective Service System.
 
18      The legislature finds that there will be no additional
 
19 burden placed on the University of Hawaii system or a state or

 1 county hiring agency because the applicant has the burden of
 
 2 producing documentation.  The legislature further finds that
 
 3 conscientious objectors will not be adversely affected because,
 
 4 if they have complied with the federal law, they will have
 
 5 already registered with the Selective Service as conscientious
 
 6 objectors, and will therefore be able to provide documentation
 
 7 that they have registered.
 
 8      Finally, this Act applies only to those individuals between
 
 9 the ages of eighteen and twenty-five who are required to register
 
10 with the Selective Service.  Individuals twenty-five years or
 
11 older who failed to comply with the Selective Service Act are now
 
12 past the upper age limit and are not allowed to register, and
 
13 will therefore continue to be eligible for state and county
 
14 employment and admission to public institutions of higher
 
15 education.
 
16      SECTION 2.  Chapter 78, Hawaii Revised Statutes, is amended
 
17 by adding a new section to be appropriately designated and to
 
18 read as follows:
 
19      "�78-     Compliance with the Military Selective Service
 
20 Act.  (a)  Except as provided in subsection (b), no person who is
 
21 required to register with the Selective Service System shall be
 
22 eligible for employment by any agency of the State or any county
 
23 unless the person provides written documentation from the

 1 Selective Service System that the person has registered or is
 
 2 otherwise in compliance with the Military Selective Service Act,
 
 3 50 U.S.C. section 451 et seq.
 
 4      (b)  This section shall apply only to persons between the
 
 5 ages of eighteen and twenty-five who are required to register
 
 6 with the Selective Service System.  This section shall not apply
 
 7 to those persons who have failed to comply with the Military
 
 8 Selective Service Act and have reached an age of at least twenty-
 
 9 five years, upon which the requirement of registration has been
 
10 terminated."
 
11      SECTION 3.  Chapter 304, Hawaii Revised Statutes, is amended
 
12 by adding a new section to read as follows:
 
13      "�304-     Compliance with the Military Selective Service
 
14 Act.  (a)  Except as provided in subsection (b), no person who is
 
15 required to register with the Selective Service System shall be
 
16 eligible for admission into any public institution of higher
 
17 education in this State unless the person provides written
 
18 documentation from the Selective Service System that the person
 
19 has registered with or is otherwise in compliance with the
 
20 Military Selective Service Act, 50 U.S.C. section 451 et seq."
 
21      (b)  This section shall apply only to persons between the
 
22 ages of eighteen and twenty-five who are required to register
 
23 with the Selective Service System.  This section shall not apply

 5      SECTION 4.  This Act shall not apply to any person employed
 
 6 by any agency of the State or any county, or admitted to a public
 
 7 institution of higher education in this State, prior to the
 
 8 effective date of this Act.
 
 9      SECTION 5.  New statutory material is underscored.
 
10      SECTION 6.  This Act shall take effect upon its approval.
