                     A BILL FOR AN ACT

RELATING TO CIVIL PENALTIES FOR ILLEGAL USE OF FIREWORKS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  Section 132D-14, Hawaii Revised Statutes, is
 
 2 amended to read:
 
 3      "[�132D-14]  Penalty.(a)  Any person importing aerial
 
 4 common fireworks or special fireworks into the State without
 
 5 first having obtained a license as required by section 132D-7
 
 6 shall be guilty of a class C felony.
 
 7      (b)  Except as provided in subsection (a), any person
 
 8 violating any other provision of this chapter, shall [be guilty
 
 9 of a petty misdemeanor.] by law, pay a fine of $250 for a first
 
10 violation and $400 for each subsequent violation.  The funds
 
11 collected under this subsection shall be expended by the law
 
12 enforcement agency issuing the violation for law enforcement."
 
13      SECTION 2.  New statutory material is underscored.
 
14      SECTION 3.  This Act shall take effect upon approval.
