Vehicle Registration

Allows motor vehicle owners to be refunded for motor vehicle
registration fees if the vehicle is inoperable.

                   A  BILL  FOR  AN  ACT



 1      SECTION 1.  Chapter 286, Hawaii Revised Statutes, is amended
 2 by adding a new section to part III to be appropriately
 3 designated and to read as follows:
 4      "286-     Inoperable motor vehicles; pro rata refund of
 5 motor vehicle registration fees.  (a)  If a motor vehicle that is
 6 registered in this State becomes inoperable, the owner of the
 7 motor vehicle may apply to the county director of finance stating
 8 the fact and request suspension of the registration of the
 9 vehicle.  Upon receipt of the application, the county director of
10 finance may suspend registration of the vehicle and reimburse the
11 applicant for a portion of the registration fees paid for the
12 current year on a pro rata basis according to the number of days
13 the vehicle is unused.
14      (b)  A motor vehicle, whose registration has been suspended
15 pursuant to subsection (a), shall not be operated upon the public
16 highways unless:
17      (1)  The motor vehicle has been rendered operable;
18      (2)  The owner has applied for the reinstatement of the
19           registration of the vehicle with the county director of
20           finance; and

 1      (3)  The county director of finance has approved the
 2           reinstatement of registration."
 3      SECTION 2.  Section 286-61, Hawaii Revised Statutes, is
 4 amended to read as follows:
 5      "286-61  Penalty.  Any person who violates sections 286-41, 
 6 286-42, 286-44.5 to 286-56.5, [and] 286-58 to 286-60, and 286-   
 7 shall be fined not less than $5 nor more than $1,000; provided
 8 that any corporate owner of a motor vehicle who fails to register
 9 a motor vehicle as required by section 286-41(a) following a
10 transfer of the vehicle between counties shall be fined $1,000
11 for each violation.  Any person who violates section 286-43,
12 286-44, or 286-57 shall be fined not less than $5 and not more
13 than $1,000 or imprisoned not more than one year, or both."
14      SECTION 3.  Statutory material to be repealed is bracketed.
15 New statutory material is underscored.
16      SECTION 4.  This Act shall take effect upon its approval.
