                   A  BILL  FOR  AN  ACT

RELATING TO THE BUDGET.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 37, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "�37-    Department of human services; awards.  (a)  The
 
 5 department of human services shall be appropriated an amount of
 
 6 general funds equal to the amount of federal funds awarded to the
 
 7 department for superior performance for:
 
 8      (1)  Providing high quality, efficient, and effective
 
 9           services designed to achieve self-sufficiency for
 
10           clients as quickly as possible; and
 
11      (2)  Directing the State's limited resources toward helping
 
12           those least able to care for themselves;
 
13 for the purposes of the department of human services at the close
 
14 of a fiscal year.  The funds retained shall not lapse until
 
15 June 30 of the first fiscal year of the next fiscal biennium.
 
16      (b)  The department of human services shall submit:
 
17      (1)  A report to the director of finance, by the close of
 
18           the first fiscal year, identifying the total amount of
 
19           funds under this section that will carry over to the
 
20           second fiscal year; and

 1      (2)  A copy of the report prepared pursuant to paragraph (1)
 
 2           to the legislature, as well as a report identifying the
 
 3           awarded funds, at least twenty days prior to the
 
 4           convening of the next regular session of the
 
 5           legislature.
 
 6      (c)  Any appropriation awarded in accordance with this
 
 7 section shall:
 
 8      (1)  Be used toward the general operations of the department
 
 9           of human services;
 
10      (2)  Maintain and enhance the superior performance of units
 
11           which were responsible for the funds being awarded to
 
12           the State; and
 
13      (3)  Not exceed the amount of the federal funds awarded;
 
14           provided that the awarded funds not supplant existing
 
15           funds."
 
16      SECTION 2.  Section 37-41, Hawaii Revised Statutes, is
 
17 amended to read as follows:
 
18      "�37-41  Appropriations to revert to state treasury;
 
19 exceptions.  Unless otherwise provided by [section] sections
 
20 37-41.5 and 37-    or any other law, every appropriation or part
 
21 thereof of any kind made subject to sections 37-31 to 37-40,
 
22 remaining unexpended and unencumbered at the close of any fiscal
 
23 year shall lapse and be returned to the general fund in the
 
24 manner prescribed in section 40-66."

 1      SECTION 3.  Statutory material to be deleted is bracketed.
 
 2 New statutory material is underscored.
 
 3      SECTION 4.  This Act shall take effect upon its approval.
