                     HOUSE  CONCURRENT
                        RESOLUTION
  AUTHORIZING THE LEASE OF SUBMERGED LANDS AT DUKE KAHANAMOKU
     BEACH AT WAIKIKI, HONOLULU, OAHU, FOR PIER PURPOSES.



 1        WHEREAS, the pier located at Duke Kahanamoku Beach
 2   fronting the Hilton Hawaiian Village is a result of a 1955
 3   joint agreement between the Territory of Hawaii and Henry J.
 4   Kaiser for the development of the Hilton lagoon and the
 5   creation of Duke Kahanamoku Beach; and
 6   
 7        WHEREAS, the Board of Harbor Commissioners issued various
 8   licenses to Kaiser-Burns Development Corporation between 1956
 9   and 1960 and a revocable permit in 1961 to Hilton-Hotels
10   Corporation for the submerged lands under the pier; and
11   
12        WHEREAS, on September 1, 1964, the Board of Land and
13   Natural Resources issued Revocable Permit No. S-3528 to Hilton-
14   Burns Hotels Company, Inc., now known as Hilton Hawaiian
15   Village, for approximately 3,917 square feet of submerged lands
16   for catwalk, catamaran pier and power boat pier; and
17   
18        WHEREAS, Revocable Permit No. S-3528 continues to exist
19   today; and
20   
21        WHEREAS, the pier was originally intended and used as an
22   amenity for Hilton Hawaiian Village hotel guests from where
23   they could enjoy catamaran rides and dinner cruises; and
24   
25        WHEREAS, since the early 1990's, the pier has evolved to
26   include multi-purpose uses by non-Hilton hotel guests,
27   including shuttling service to Atlantis submarine rides, which
28   has increased the pier's usage; and
29   
30        WHEREAS, the Department of Land and Natural Resources
31   (Department) has determined that the revocable permit is no
32   longer the appropriate disposition of the submerged public
33   lands underlying the pier and that a long-term general lease is
34   the appropriate vehicle; and
35   
36        WHEREAS, the Department, in conjunction with the
37   Department of the Attorney General, has determined that the
38   appropriate disposition method of a general lease is public

 1   auction; and WHEREAS, section 171-53, Hawaii Revised Statutes,
 2   requires the prior approval of the Governor and prior
 3   authorization of the Legislature by concurrent resolution,
 4   before submerged public lands may be leased; and
 5   
 6        WHEREAS, the Legislature desires to authorize the Board of
 7   Land and Natural Resources to lease certain submerged lands at
 8   Duke Kahanamoku Beach at Waikiki, Honolulu, Oahu, for pier
 9   purposes to stimulate tourist activity; and
10   
11        WHEREAS, in order to sell a lease at public auction for
12   submerged lands, all appropriate authorizations are required;
13   now, therefore, 
14   
15        BE IT RESOLVED by the House of Representatives of the
16   Twentieth Legislature of the State of Hawaii, Regular Session
17   of 2000, the Senate concurring, that the Board of Land and
18   Natural Resources is hereby authorized to lease submerged lands
19   at Duke Kahanamoku Beach at Waikiki, Honolulu, Oahu, for pier
20   purposes pursuant to section 171-53, Hawaii Revised Statutes;
21   and
22   
23        BE IT FURTHER RESOLVED that certified copies of this
24   Concurrent Resolution be transmitted to the Chairperson of the
25   Board of Land and Natural Resources.
