                     HOUSE CONCURRENT
                        RESOLUTION
REQUESTING THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO WORK
   WITH SERVICE PROVIDERS AND THE DEPARTMENT OF HEALTH TO
   DETERMINE A REASONABLE RENTAL FEE TO IMPROVE INFRASTRUCTURE
   ON THE WAIMANO TRAINING SCHOOL AND HOSPITAL GROUNDS.



 1       WHEREAS, with the closure of Waimano Training School and
 2   Hospital (Waimano) on June 30, 1999, the Department of Health
 3   (DOH) gave permission to several not-for-profit adult day
 4   programs that provide services to persons with mental
 5   retardation and developmental disabilities (MR/DD) to use
 6   specified facilities for a nominal fee; and
 7   
 8       WHEREAS, the nominal fee has been used to upkeep and
 9   maintain the buildings that house these programs, such as Kokua
10   Mau Work Center, the Home and Community Services in Hawaii,
11   Manawa Lea Health Services, the Special Education Centers of
12   Hawaii, and the Research Center of Oahu; and
13   
14       WHEREAS, with the closure of Waimano in 1999, the
15   Department of Land and Natural Resources (DLNR) became the
16   property manager of the Waimano grounds; and
17   
18       WHEREAS, recently, DLNR has assessed a rental fee of $6,000
19   per month to these not-for-profit adult day programs to upgrade
20   infrastructure, such as maintenance to the water tank and
21   potholes in the roads; and
22   
23       WHEREAS, this exorbitant fee will most likely run these
24   organizations out of business, all of whom are providing
25   invaluable community-based services for persons with
26   developmental disabilities; and
27   
28       WHEREAS, without these providers, there will be minimal
29   services available, especially if the waitlist for the Medicaid
30   Home- and Community-based Services Waiver Program is decreased
31   or eliminated; and
32   
33       WHEREAS, assessing service providers $6,000 per month for
34   infrastructure raises the question, "What has DOH done over the
35   years to maintain infrastructure for the Waimano grounds while
36   under DOH's control?"; now, therefore,

 1       BE IT RESOLVED by the House of Representatives of the
 2   Twentieth Legislature of the State of Hawaii, Regular Session
 3   of 2000, the Senate concurring, that DLNR work with the service
 4   providers and DOH to determine a reasonable rental fee to
 5   improve infrastructure on the Waimano grounds; and
 6   
 7       BE IT FURTHER RESOLVED that DLNR consider the following
 8   alternatives:
 9   
10       (1)  Exempting not-for-profit adult day programs that
11            provide services to the MR/DD population from the
12            $6,000 rental fee;
13   
14       (2)  Determining a reasonable rental fee and assessing that
15            fee as a starting point, with the intention to
16            increase the fee under specified conditions; and
17   
18       (3)  Simultaneously maintaining, or providing assistance to
19            maintain, the buildings that house the programs while
20            these discussions occur;
21   
22   and
23   
24       BE IT FURTHER RESOLVED that DLNR submit a report of the
25   actions taken pursuant to this request to the Legislature no
26   later than twenty days prior to the convening of the Regular
27   Session of 2001; and
28   
29       BE IT FURTHER RESOLVED that certified copies of this
30   Concurrent Resolution be transmitted to the Directors of Land
31   and Natural Resources and Health, and the Executive Directors
32   of Kokua Mau Work Center, the Home and Community Services in
33   Hawaii, Manawa Lea Health Services, the Special Education
34   Centers of Hawaii, and the Research Center of Oahu.
