                     HOUSE  RESOLUTION
  REQUESTING THE LEGISLATIVE REFERENCE BUREAU TO STUDY THE
    ADVISABILITY OF REQUIRING ALL LICENSED GUARD AGENCIES,
    LICENSED GUARDS, AND UNLICENSED AGENTS, OPERATIVES, AND
    ASSISTANTS OF LICENSED GUARD AGENCIES TO COMPLETE A
    STANDARDIZED TRAINING PROGRAM IN PRIVATE SECURITY.



 1        WHEREAS, section 463-1, Hawaii Revised Statutes, defines a
 2   "guard" as a licensed uniformed or nonuniformed person
 3   responsible for the safekeeping of a client's properties and
 4   persons within contractually prescribed boundaries, and for
 5   observation and reporting relative to that safekeeping; and
 6   
 7        WHEREAS, section 463-7(a), Hawaii Revised Statutes,
 8   prohibits an individual from engaging in the business of guard
 9   for the purpose of protecting persons or property or to prevent
10   the theft or unlawful taking of goods, wares, merchandise,
11   money, bonds, documents, or other articles of value for hire or
12   reward, without first obtaining a license as a guard from the
13   Board of Private Detectives and Guards; and
14   
15        WHEREAS, section 463-8(b), Hawaii Revised Statutes,
16   exempts agents, operatives, and assistants of licensed guard
17   agencies working in a guard capacity from the requirement to
18   have a guard license, to have had a high school education or
19   its equivalent, and to have had experience reasonably
20   equivalent to at least four years of full-time guard work; and
21   
22        WHEREAS, neither licensed guard agencies, licensed guards,
23   nor unlicensed agents, operatives, and assistants of licensed
24   guard agencies working in a guard capacity are required by law
25   or rule to complete a standardized training program consisting
26   of such essentials as report writing, communicating with the
27   public, criminal and civil law, and the legal aspects of
28   private security; and
29   
30        WHEREAS, because of Hawaii's high property crime rate--
31   ninth worst in the United States during 1998, more and more
32   private businesses and individuals, as well as government
33   agencies, are turning to private guards to safeguard their
34   customers, merchandise, families, homes, and employees, and to
35   maintain order and civility in places where people congregate
36   in large numbers; and

 1        WHEREAS, training all private guards to an acceptable
 2   level of proficiency in this profession would increase their
 3   effectiveness and efficiency and would allow police officers
 4   and other law enforcement personnel to focus more of their time
 5   and effort on preventing and solving violent crimes and
 6   property crimes, especially crimes against tourists; now,
 7   therefore
 8   
 9        BE IT RESOLVED by the House of Representatives of the
10   Twentieth Legislature of the State of Hawaii, Regular Session
11   of 2000, that the Legislative Reference Bureau is requested to
12   study the advisability of requiring all licensed guard
13   agencies, licensed guards, and unlicensed agents, operatives,
14   and assistants of licensed guard agencies working in a guard
15   capacity to complete a standardized training program consisting
16   of such essentials as report writing, communicating with the
17   public, criminal and civil law, and the legal aspects of
18   private security; and
19   
20        BE IT FURTHER RESOLVED that the Legislative Reference
21   Bureau is requested to submit its findings and recommendations
22   to the Legislature not less than twenty days prior to the
23   convening of the Regular Session of 2001; and
24   
25        BE IT FURTHER RESOLVED that certified copies of this
26   Resolution be transmitted to the Director of Commerce and
27   Consumer Affairs, the Chairperson of the Board of Private
28   Detectives and Guards, and the Director of the Legislative
29   Reference Bureau.
