                   A  BILL  FOR  AN  ACT

RELATING TO THE SUPERINTENDENT OF EDUCATION.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 26-52, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "�26-52  Department heads and executive officers.  The
 
 4 salaries of the following state officers shall be as follows:
 
 5      (1)  The salary of the superintendent of education shall be
 
 6           [$90,041 a year;] set by the board of education at a
 
 7           rate no greater than $150,000 a year;
 
 8      (2)  The salary of the president of the University of Hawaii
 
 9           shall be set by the board of regents;
 
10      (3)  The salaries of all department heads or executive
 
11           officers of the departments of accounting and general
 
12           services, agriculture, attorney general, budget and
 
13           finance, business, economic development, and tourism,
 
14           commerce and consumer affairs, Hawaiian home lands,
 
15           health, human resources development, human services,
 
16           labor and industrial relations, land and natural
 
17           resources, public safety, taxation, and transportation
 
18           shall be $85,302 a year; and
 
19      (4)  The salary of the adjutant general shall be $85,302 a
 
20           year; provided that if this salary is in conflict with

 1           the pay and allowance fixed by the tables of the
 
 2           regular army or air force of the United States, the
 
 3           latter shall prevail."
 
 4      SECTION 2.  Statutory material to be repealed is bracketed.
 
 5 New statutory material is underscored.
 
 6      SECTION 3.  This Act shall take effect upon its approval.
