                   A  BILL  FOR  AN  ACT
RELATING TO HUMAN RESOURCES MANAGEMENT IN STATE GOVERNMENT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 76, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "�76-     Demonstration projects.  (a)  The director of
 
 5 human resources development, with the approval of the governor,
 
 6 may conduct demonstration projects to determine whether a
 
 7 specific change in human resource management procedures, methods,
 
 8 policies, or statutes would result in improved human resource
 
 9 management within the State.
 
10      (b)  Prior to implementing any demonstration project, the
 
11 director shall develop a plan that identifies the purposes of the
 
12 project, the methodology to be used, the duration of the project,
 
13 the methodology and criteria for evaluation of the project, and,
 
14 if applicable, the cost of the project.
 
15      (c)  The conduct of demonstration projects shall not be
 
16 limited by the provisions of chapter 76 and chapter 77 and
 
17 existing civil service rules and procedures, except that no
 
18 project shall waive or abridge equal employment opportunity
 
19 rights or those prohibiting discrimination based on race, sex,

 1 age, religion, color, ancestry, politics, physical or mental
 
 2 disability, marital status, or sexual orientation.
 
 3      (d)  Should any project have a significant impact on
 
 4 existing employees, consultation with appropriate exclusive
 
 5 representatives prior to implementation is required.  Should any
 
 6 project involve modification of any terms and conditions of a
 
 7 valid collective bargaining agreement, an agreement amending
 
 8 those specifics shall be negotiated with the exclusive
 
 9 representative, prior to implementation.
 
10      (e)  The director, through the office of the governor, shall
 
11 submit an annual report to the legislature on any approved
 
12 demonstration projects, including the plan, status, and, as
 
13 applicable, results of the project for its information."
 
14      SECTION .  Section , Hawaii Revised Statutes, is amended to
 
15 read as follows:
 
16      "�76-29  Person ineligible for appointment.  [No] Any person
 
17 who provided false statements or has committed or attempted any
 
18 deception, or used or obtained any unauthorized or improper
 
19 assistance in connection with an examination, or fraud in
 
20 connection with any application or examination, shall be
 
21 [eligible] ineligible for any appointment in the civil service[.]
 
22 for a specified period of time as determined appropriate by the

 1 director or by administrative rule."
 
 2      SECTION 3.  Statutory material to be repealed is bracketed.
 
 3 New statutory material is underscored.
 
 4      SECTION 4.  This Act shall take effect upon its approval.
