DESCRIPTION:
Defines "recycled water" and "reclaimed water" as water, which,
as a result of treatment of waste, is suitable for a direct
beneficial use or a controlled use that would not otherwise occur

                   A  BILL  FOR  AN  ACT

RELATING TO WASTEWATER REUSE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that Hawaii is blessed
 
 2 with an abundance of freshwater.  However, the future
 
 3 sustainability of freshwater is not so certain.  Demands for
 
 4 water may outpace our available supplies.  Therefore, we need to
 
 5 look to other sources of water for agricultural and irrigation
 
 6 uses.  One such source is wastewater reuse.  Other states where
 
 7 water is in short supply are doing much more to reuse wastewater.
 
 8 Hawaii can also do much more to close the water recycle gap.
 
 9 State laws and rules need to be changed to encourage reuse of
 
10 water, to authorize the distribution and sale of recycled water,
 
11 and to clarify who is liable for the health and environmental
 
12 risks of recycling treated water.
 
13      SECTION 2.  Section 342D-1, Hawaii Revised Statutes, is
 
14 amended by adding a new definition to be appropriately inserted
 
15 and to read as follows:
 
16      ""Recycled water" and "reclaimed water" mean water, which,
 
17 as a result of treatment of waste, is suitable for a direct
 
18 beneficial use or a controlled use that would not otherwise occur
 
19 and is therefore considered a valuable resource."

 1      SECTION 3.  New statutory material is underscored.
 
 2      SECTION 4.  This Act shall take effect upon its approval.
