                   A BILL FOR AN ACT

RELATING TO MOTOR CARRIERS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that current state law

that requires the monitoring of storm water runoff by motor

carriers is excessively burdensome.

The purpose of this Act is to conform Hawaii's practice of

monitoring storm water runoff from motor carriers to that of the

majority of the states by permitting visual monitoring and

analysis of storm water runoff.

SECTION 2. Chapter 271, Hawaii Revised Statutes, is amended

by adding a new section to be appropriately designated and to

read as follows:

"271- Motor carriers and private carriers of property

by motor vehicles; monitoring. Any monitoring of storm water

runoff by a motor carrier or private carrier of property by motor

vehicle that is required by law shall be done by visual

observation of color, odor, turbidity, floating solids, foam,

oil, sheen, or other obvious indicators of storm water pollution.

The examination shall be conducted in a well lighted area. No

laboratory tests are required to be performed on any samples

gathered."
