Social Security Numbers: Use

Prohibits use of social security numbers for public
identification purposes.

                   A  BILL  FOR  AN  ACT



 1      SECTION 1.  Section 286-109, Hawaii Revised Statutes, is
 2 amended to read as follows:
 3      "286-109  General provision governing the issuance of
 4 licenses.  Upon payment of the required fee and upon
 5 demonstrating the ability to operate a certain category or
 6 categories of motor vehicles to the satisfaction of the examiner
 7 of drivers, an applicant for a driver's license shall be issued a
 8 single license of a design approved by the director of
 9 transportation upon which is made a notation of the category or
10 categories of motor vehicles the applicant may operate, any
11 restrictive provisions to which the license is subject, and,
12 where the license is issued to a person under twenty-one years of
13 age, a statement, in clearly legible print that shall contrast
14 with the other information appearing on the license, which
15 indicates the date on which the person will attain the age of
16 twenty-one years.
17      Statutes of limitations and other provisions of this chapter
18 notwithstanding, no driver's license or instruction permit shall
19 be issued or renewed under this section, where the examiner of
20 drivers is notified by the district judge, traffic violations

 1 bureaus of the district courts, or the judge of the circuit court
 2 that the applicant has failed to respond to a traffic citation or
 3 summons for the violation of any traffic laws of a county, this
 4 chapter or chapters 286G, 287, 290, 291, or 291C, and the same
 5 remains delinquent and outstanding, or the applicant, having
 6 timely responded initially, has as of the time of the
 7 application, failed to comply in full with all orders of the
 8 court.
 9      The examiner of drivers shall not issue or renew any
10 driver's license or instruction permit certificate using the
11 driver's social security number as the license or instruction
12 permit identification number.  An individual's social security
13 number shall not be included on a driver's license or instruction
14 permit for identification or for any other purpose."
15      SECTION 2.  Section 286-239, Hawaii Revised Statutes, is
16 amended by amending subsection (a) to read as follows:
17      "286-239  Commercial driver's license.  (a)  The commercial
18 driver's license shall be marked "CDL" and, to the maximum extent
19 practicable, shall be tamperproof and include, but not be limited
20 to, the following with respect to the licensee:
21      (1)  The name and residence address;
22      (2)  A color photograph;

 1      (3)  A physical description including sex and height;
 2      (4)  Date of birth;
 3      [(5) Social security number;
 4      (6)](5)Signature;
 5      [(7)](6)The class or type of commercial motor vehicle or
 6 vehicles which may be driven together with any endorsements or
 7 restrictions;
 8      [(8)](7)The name of this State; and
 9      [(9)](8)  The issuance and expiration dates of the license."
10      SECTION 3.  Section 846-30, Hawaii Revised Statutes, is
11 amended to read as follows:
12      "846-30  Identification certificates; form.  The department
13 of the attorney general, after taking the thumbprint of each
14 registrant as provided in this part (except as otherwise provided
15 in the case of children under three years of age), and after
16 securing the information required by or pursuant to this part,
17 shall issue to each registrant a certificate of identification in
18 such form, and with such information, as the attorney general
19 deems necessary and practicable, the certificate to contain,
20 among other things: [the registrant's social security number;]
21 the date of issue; the legal name, residence, citizenship, date
22 of birth, the registrant's signature, a facsimile signature of

 1 the attorney general, a facsimile signature of the officer or
 2 employee issuing the certificate (to be designated as the
 3 "administrator of the data center"), the name and address of the
 4 person to be notified in case of need, and such other personal
 5 identification data as the attorney general deems necessary and
 6 practicable[.]; provided that the registrant's social security
 7 number shall not be printed on the certificate of
 8 identification."
10      SECTION 4.  Statutory material to be repealed is bracketed.
11 New statutory material is underscored.
12      SECTION 5.  This Act shall take effect upon its approval.
