DESCRIPTION:
Clarifies that the penalty applied to employers for unjustified
wage withholding will be equal to the amount of unpaid wages and
interest at a rate of six per cent per year from the date the

                   A  BILL  FOR  AN  ACT

RELATING TO WAGES AND COMPENSATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 388-10, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (a) to read as follows:
 
 3      "(a)  Civil.  Any employer who fails to pay wages in
 
 4 accordance with this chapter without equitable justification
 
 5 shall be liable to the employee, in addition to the wages legally
 
 6 proven to be due, for a sum [up] equal to the amount of unpaid
 
 7 wages and interest at a rate of six per cent per year from the
 
 8 date that the wages were due."
 
 9      SECTION 2.  Statutory material to be repealed is bracketed.
 
10 New statutory material is underscored.
 
11      SECTION 3.  This Act shall take effect upon its approval.
