                   A  BILL  FOR  AN  ACT

RELATING TO PUBLIC LAND TRUST.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 10-13.3, Hawaii Revised Statutes, is
 
 2 amended to read as follows:
 
 3      "[[]�10-13.3[]]  Interim revenue.  Notwithstanding the
 
 4 definition of revenue contained in this chapter and the
 
 5 provisions of section 10-13.5, and notwithstanding any claimed
 
 6 invalidity of Act 304, Session Laws of Hawaii 1990, the income
 
 7 and proceeds from the pro rata portion of the public land trust
 
 8 under article XII, section 6 of the state constitution for
 
 9 expenditure by the office of Hawaiian affairs for the betterment
 
10 of the conditions of native Hawaiians for each of fiscal year
 
11 1997-1998 and fiscal year 1998-1999 shall be $15,100,000.  For
 
12 fiscal year 2000-2001, the amount shall be $         ; provided
 
13 that the sum appropriated to the office of Hawaiian affairs to
 
14 effectuate this section shall be credited toward any sum that may
 
15 be paid by the State, pursuant to section 10-13.5, for the twenty
 
16 per cent revenue derived from the public land trust for these
 
17 fiscal years, until the ceded lands inventory is completed.  If
 
18 the sum appropriated is less than what the State owes, then the
 
19 State shall make an additional payment equaling the difference

 1 between the sum appropriated and the amount owed.  If the sum
 
 2 appropriated is more than what the State owes, then the State
 
 3 shall be credited the difference between the amount owed and the
 
 4 sum appropriated."
 
 5      SECTION 2.  There is appropriated out of the general
 
 6 revenues of the State of Hawaii the sum of $         , or so much
 
 7 thereof as may be necessary for fiscal year 2000-2001, to be
 
 8 transferred to and expended by the office of Hawaiian affairs for
 
 9 the betterment of Hawaiians and native Hawaiians as mandated
 
10 under chapter 10, Hawaii Revised Statutes.
 
11      SECTION 3.  Statutory material to be repealed is bracketed.
 
12 New statutory material is underscored.
 
13      SECTION 4.  This Act shall take effect on July 1, 2000.
