                   A  BILL  FOR  AN  ACT

RELATING TO A FEASIBILITY STUDY TO BUILD A PRISON AT BARBERS
   POINT.


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that the State needs to
 
 2 build a new prison to house an overflowing number of inmates that
 
 3 currently are sent to mainland prisons on contract with the State
 
 4 for this purpose.  The legislature further finds that a new
 
 5 prison should be built in Hawaii to stimulate the economy and to
 
 6 provide a sense of ohana to inmates as they serve their time.
 
 7      The legislature further finds that Barbers Point, located on
 
 8 Oahu in the area known as Kalaeloa, is presently open to
 
 9 development.  The original plans for building housing at Barbers
 
10 Point have shifted to opening up more space for light industry,
 
11 due to the incompatibility of housing with the concentration of
 
12 heavy industry in the area.
 
13      The legislature further finds that Barbers Point may be an
 
14 ideal setting for a new prison, which would be comparable to a
 
15 light industrial use of the area.
 
16      The purpose of this Act is to make an appropriation for a
 
17 study of the feasibility and advisability of building a new
 
18 prison at Barbers Point.
 
19      SECTION 2.  (a)  The department of public safety shall

 1 undertake or cause to be undertaken a study to examine the
 
 2 feasibility and advisability of building a new prison at Barbers
 
 3 Point.  The awarding of a contract for the study shall comply
 
 4 with chapter 103D, Hawaii Revised Statutes.
 
 5      (b)  The contract shall contain a provision requiring the
 
 6 contractor to complete a report no later than December 15, 2000,
 
 7 to allow the legislature to act on the recommendation in the 2001
 
 8 session.  The report shall be submitted by the contractor upon
 
 9 completion to the department of public safety, the governor, the
 
10 senate, and the house of representatives.  The department of
 
11 public safety may submit comments on the report no later than
 
12 December 28, 2000, to the senate and the house of
 
13 representatives. 
 
14      SECTION 3.  There is appropriated out of the general
 
15 revenues of the State of Hawaii the sum of $          , or so
 
16 much thereof as may be necessary for fiscal year 2000-2001, for a
 
17 study to examine the feasibility and advisability of building a
 
18 new prison at Barbers Point, Island of Oahu.
 
19      SECTION 4.  The sum appropriated shall be expended by the
 
20 public safety for the purposes of this Act.
 
21      SECTION 5.  This Act shall take effect on July 1, 2000.
