Aquaculture

DESCRIPTION:
Allows the DOA to charge fees for aquatic animal and plant health
diagnostic services and for expert services related to
aquaculture planning, disease management, and the marketing of
seafood products.  Establishes the Aquaculture Development

                   A  BILL  FOR  AN  ACT

RELATING TO AQUACULTURE.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 141, Hawaii Revised Statutes, is amended
 
 2 by adding a new section to be appropriately designated and to
 
 3 read as follows:
 
 4      "141-   Fees for aquaculture services.  The department of
 
 5 agriculture may establish and assess fees pursuant to chapter 91
 
 6 for aquatic animal and plant health diagnostic services, and for
 
 7 any items or expert services purchased from the department
 
 8 related to aquaculture planning, disease management, and the
 
 9 marketing of seafood products; provided that the assessment of
 
10 these fees does not violate any other provision of this chapter."  
 
11      SECTION 2.  Chapter 141, Hawaii Revised Statutes, is amended
 
12 by adding a new section to be appropriately designated and to
 
13 read as follows:
 
14      "141-   Aquaculture development special fund.  (a) There is
 
15 established in the state treasury the aquaculture development
 
16 special fund, into which shall be deposited:
 
17      (1)  Appropriations from the legislature to the aquaculture
 
18           development special fund;
 
19      (2)  Moneys collected as fees for special microbiological

 1           and histological procedures and expert aquaculture-
 
 2           related services;
 
 3      (3)  Moneys collected from the sale of any item related to
 
 4           aquaculture development which is purchased from the
 
 5           department;
 
 6      (4)  Moneys directed to the aquaculture development program
 
 7           from any other sources, including but not limited to
 
 8           grants, gifts, and awards; and
 
 9      (5)  Moneys derived from interest, dividend, or other income
 
10           from the above sources.
 
11      (b)  Moneys in the aquaculture development special fund
 
12 shall be used for the following purposes:
 
13      (1)  To implement the aquatic disease management programs
 
14           and activities of the department, including provision
 
15           of state funds to match federal grants; and
 
16      (2)  To support research and development programs and
 
17           activities relating to expansion of the state
 
18           aquaculture industry.  Research and development
 
19           programs and activities funded under this paragraph may
 
20           be conducted by department personnel or through
 
21           contracts with the University of Hawaii or other
 
22           qualified persons."
 
23      SECTION 3.  There is appropriated out of the aquaculture

 1 development special fund the sum of $30,000, or so much thereof
 
 2 as may be necessary for fiscal year 2000-2001 to carry out the
 
 3 purposes of the aquaculture development special fund.
 
 4      SECTION 4.  The sum appropriated shall be expended by the
 
 5 department of agriculture for the purposes of the aquaculture
 
 6 development special fund.
 
 7      SECTION 5.  New statutory material is underscored.
 
 8      SECTION 6.  This Act shall take effect on July 1, 2000.
