                   A  BILL  FOR  AN  ACT

RELATING TO STATE PARKS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Chapter 184, Hawaii Revised Statutes, is amended
 
 2 by adding to part I a new section to be appropriately designated
 
 3 and to read as follows:
 
 4      "�184-     State parks special fund.  (a)  There is
 
 5 established within the state treasury a special fund to be known
 
 6 as the state parks special fund.  All proceeds collected by the
 
 7 state parks programs involving park user fees, any leases or
 
 8 concession agreements, the sale of any article purchased from the
 
 9 department to benefit the state parks programs, or any gifts or
 
10 contributions, shall be deposited into this fund; provided that
 
11 proceeds derived from the operation of Iolani Palace shall be
 
12 used to supplement its educational and interpretive programs.
 
13      (b)  The department shall expend the moneys from the state
 
14 parks special fund for the following purposes:
 
15      (1)  Salaries and fringe benefits for permanent and
 
16           temporary staff positions;
 
17      (2)  Planning and development of state parks programs,
 
18           including the aina hoomalu state parks program;
 
19      (3)  Construction of state parks facilities;

 1      (4)  Operation and maintenance costs including repairs,
 
 2           replacements, additions, and extensions of state parks
 
 3           and state parks programs; and
 
 4      (5)  Administrative and other costs deemed necessary by the
 
 5           division of state parks."
 
 6      SECTION 2.  Section 184-32, Hawaii Revised Statutes, is
 
 7 repealed.
 
 8      ["�184-32  Aina hoomalu special fund.(a)  There is
 
 9 established within the state treasury a special fund to be known
 
10 as the aina hoomalu special fund.  All proceeds collected by the
 
11 state parks program involving park user fees or any leases or
 
12 concession agreements shall be deposited into this fund, provided
 
13 that proceeds derived from the operation of Iolani Palace shall
 
14 be used to supplement its educational and interpretive programs.
 
15      (b)  The department shall expend the moneys from the aina
 
16 hoomalu special fund after July 1, 1992.  The funds shall be used
 
17 for the following purposes:
 
18      (1)  Permanent staff positions;
 
19      (2)  Planning and development of interpretive programs;
 
20      (3)  Construction of interpretive facilities;
 
21      (4)  Repairs, replacements, additions, and extensions;
 
22      (5)  Operation and maintenance costs of programs; and
 
23      (6)  Administrative costs of the division of state parks."]

 1      SECTION 3.  The director of finance shall transfer the
 
 2 unexpended balance, including encumbrances and accrued
 
 3 liabilities, of the aina hoomalu special fund calculated as of
 
 4 the close of business on June 30, 2000, to the credit of the
 
 5 state parks special fund.  Encumbered moneys shall continue to be
 
 6 encumbered until paid out or released from prior encumbrances.
 
 7      SECTION 4.  There is appropriated out of the state parks
 
 8 special fund the sum of $       , or so much thereof as may be
 
 9 necessary for fiscal year 2000-2001, to be expended by the
 
10 department of land and natural resources for the purposes of the
 
11 state parks special fund.
 
12      SECTION 5.  Statutory material to be repealed is bracketed.
 
13 New statutory material is underscored.
 
14      SECTION 6.  This Act shall take effect on July 1, 2000.
