                   A  BILL  FOR  AN  ACT

RELATING TO SCHOOL/COMMUNITY-BASED MANAGEMENT. 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:


 1      SECTION 1.  The purpose of this bill is to require the
 
 2 department of education to provide support to schools that
 
 3 participate in the school/community-based management (SCBM)
 
 4 system for training principals and other members of the school
 
 5 councils in order to help them provide effective management of
 
 6 their schools.
 
 7       When SCBM was passed, the purpose of the initiative was to
 
 8 encourage decentralized decision-making in the department of
 
 9 education.  SCBM provides individual schools more control over
 
10 their programs by allowing schools to request waivers and
 
11 exemptions from certain board of education rules and policies and
 
12 collective bargaining contract provisions.  The legislature held
 
13 that this empowerment would increase accountability at the school
 
14 level and result in improved student performance.
 
15      When the legislature considered adopting SCBM, mainland
 
16 experts who had worked with site-based management systems in a
 
17 number of other jurisdictions emphasized that in order for the
 
18 councils to be effective, their members must receive strong

 1 support and training.  Comprehensive training has never been
 
 2 provided to the councils in Hawaii and too often council members
 
 3 have expressed feelings of powelessness.
 
 4      In 1998, the legislative auditor evaluated the
 
 5 implementation of SCBM.  The title of the report, Audit of the
 
 6 Decentralization Efforts of the Department of Education,
 
 7 highlighted various problems in decentralizing the education
 
 8 system, among them the lack of training and support for SCBM
 
 9 members.
 
10      SECTION 2. Section 302A-1125 is amended to read as follows:
 
11      "302A-1125  Educational objectives.  The board shall
 
12 formulate such policy and exercise such control as may be
 
13 necessary to define a common set of educational goals that the
 
14 schools subject to the school/community-based management system
 
15 shall be responsible for fulfilling. The board shall insure that
 
16 resources are made available for leadership training for
 
17 school/community-based management principals and school council
 
18 members to help them fulfill those responsibilities.  The board
 
19 shall also be responsible for formulating standards for measuring
 
20 the efforts of each participating school toward achieving those
 
21 goals each year.  The participating schools shall be free to use
 
22 all reasonable means to accomplish those goals with resources
 
23 available to them."

 1      SECTION 3.  New statutory material is underscored.
 
 2      SECTION 4.  This Act shall take effect upon its approval.
