 1 school boundary in which the student resides, the parent or
 
 2 guardian of the student shall submit an application for transfer
 
 3 by January 15, for initial enrollment beginning the following
 
 4 school year.  On the application form, which will be 
 
 5 provided by the department of education, a parent or guardian
 
 6 shall request a particular school or program they want the child
 
 7 to attend. 
 
 8      (c) The school or program to which the student has applied
 
 9 shall provide the parent with written notice by February 15
 
10 stating whether the application has been accepted or rejected.
 
11 If an application is rejected the school must state the reason
 
12 for rejection.  If the student is accepted, the parent or
 
13 guardian must notify the non-resident school by March 1 whether
 
14 the student will attend the non-resident school to which they
 
15 have applied.  Notice of intent on behalf of the student
 
16 obligates that student to attend the non-resident school the
 
17 following year, unless the principals of the non-resident and the
 
18 resident schools agree to allow the student to transfer back to
 
19 the resident school, the student's parent or guardian changes
 
20 residence, or in cases of exceptional circumstances that raise
 
21 unexpected barriers to the student attending the non-resident
 
22 school.  If a parent or guardian does not respond to the letter
 
23 of acceptance by the deadline, then that student will not be able
 
24 to attend the non-resident school.  The non-resident school shall
 
25 notify the resident school by March 15 of the pupil's intent to
 
26 enroll in the non-resident school.  The same procedures apply to
 
27 a student who applies to transfer from one non-resident school to

 1 another non-resident school.
 
 2      (d) Once enrolled in a non-resident school, the student may
 
 3 remain enrolled and is not required to submit annual or periodic
 
 4 applications.  To return to the resident school or to transfer to
 
 5 a different non-resident school, the parent or guardian of the
 
 6 student must submit an application of transfer by January 15 for
 
 7 enrollment beginning the following school year.
 
 8      (e) The board of education shall adopt and uniformly apply
 
 9 specific standards for acceptance and rejection of applications.
 
10 Standards may include the capacity of a program, class, grade
 
11 level, or school building.  Standards may not include previous
 
12 academic achievement, athletic or other extracurricular ability,
 
13 disabling conditions, proficiency in the English language, or
 
14 previous disciplinary proceedings.
 
15      (e) A non-resident school shall accept credits toward
 
16 graduation that were awarded by another school.
 
17      (f) Each school shall make information about its programs,
 
18 policies, and procedures available to all interested people."
 
19      SECTION 3.  New statutory material is underscored.
 
20      SECTION 4.  This Act shall take effect upon approval.
