DESCRIPTION:
Suspends driver's license of minors under 18 for 6 months,
requires community service and attendance at alcohol education
program for violating intoxicating liquor law involving minors.
Provides similar penalties for violators aged 18 to 21.  Suspends
license for 1 year for repeat offense.  Appropriates $50,000 for

                   A  BILL  FOR  AN  ACT

RELATING TO INTOXICATING LIQUOR.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  Section 281-101.5, Hawaii Revised Statutes, is
 
 2 amended by amending subsection (d) to read as follows:
 
 3      "(d)  Any person under age eighteen who violates this
 
 4 section shall be subject to the jurisdiction of the family court.
 
 5 If the family court determines that the person violated this
 
 6 section, the person's driver's license shall be suspended for six
 
 7 months.  In addition, the person shall be required to perform one
 
 8 hundred hours of community service related to the offense and,
 
 9 accompanied by a parent or guardian, attend an alcohol and drug
 
10 education program provided by the court.  Any person age eighteen
 
11 or older who violates subsection (a) shall be guilty of a
 
12 misdemeanor.  Any person age eighteen to twenty-one who violates
 
13 [subsections] subsection (b) or (c) shall be guilty of a petty
 
14 misdemeanor.  A person aged eighteen to twenty-one who violates
 
15 this section shall have the person's driver's license suspended
 
16 for six months.  In addition, the person shall be required to
 
17 perform one hundred hours of community service related to the
 
18 offense and attend an alcohol and drug education program provided
 
19 by the court.  Upon a repeat offense of subsection (b) or (c),

 1 the person's driver's license shall be suspended for one year and
 
 2 the person shall be required to perform one hundred fifty hours
 
 3 of community service related to the offense."
 
 4      SECTION 2.  There is appropriated out of the general
 
 5 revenues of the State of Hawaii the sum of $50,000, or so much
 
 6 thereof as may be necessary for fiscal year 1999-2000, for the
 
 7 purposes of providing alcohol and drug education programs to
 
 8 persons who violate section 281-101.5, Hawaii Revised Statutes,
 
 9 and are required to attend the programs.
 
10      SECTION 3.  The sum appropriated shall be expended by the
 
11 judiciary for the purposes of this Act.
 
12      SECTION 4.  This Act does not affect rights and duties that
 
13 matured, penalties that were incurred, and proceedings that were
 
14 begun, before its effective date.
 
15      SECTION 5.  Statutory material to be repealed is bracketed.
 
16 New statutory material is underscored.
 
17      SECTION 6.  This Act shall take effect on July 1, 1999.
