                   A  BILL  FOR  AN  ACT

RELATING TO MOTORCYCLE INSURANCE.
 


BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 1      SECTION 1.  The legislature finds that an unfair situation
 
 2 exists with respect to motorcycle and motor scooter riders
 
 3 seeking to obtain insurance coverage.  Under section 431:10G-104,
 
 4 Hawaii Revised Statutes, a motorcycle or motor scooter rider with
 
 5 a learner's permit is precluded from obtaining insurance coverage
 
 6 unless the rider has taken and passed a motorcycle education
 
 7 course approved by the department of transportation.  The law
 
 8 forces those riders who are unable to meet the educational
 
 9 requirement to operate their vehicles without liability coverage
 
10 while learning how to ride, thereby increasing the number of
 
11 uninsured motorists on Hawaii's streets and highways.
 
12      The purpose of this Act is to reduce the number of uninsured
 
13 motorcycle and motor scooter riders, and to allow riders with a
 
14 valid learner's permit who enroll in an approved motorcycle
 
15 education course to qualify for insurance coverage.
 
16      SECTION 2.  Section 431:10G-104, Hawaii Revised Statutes, is
 
17 amended by amending subsection (a) to read as follows:
 
18      "(a)  Any person seeking to obtain the liability coverage
 
19 required by this part after June 7, 1989, shall first:

 1      (1)  Have obtained a valid motorcycle or motor scooter
 
 2           license; or
 
 3      (2)  Have obtained a valid motorcycle or motor scooter
 
 4           learner's permit and have [taken and] enrolled in or
 
 5           passed a motorcycle education course approved by the
 
 6           department of transportation[.] or by the installation
 
 7           commander of any branch of the armed services of the
 
 8           United States; provided that the course meets the
 
 9           Motorcycle Safety Foundation standards."
 
10      SECTION 3.  Statutory material to be repealed is bracketed.
 
11 New statutory material is underscored.
 
12      SECTION 4.  This Act shall take effect upon its approval.
