Jury Service; Compensation

Removes all exemptions from jury service except previous service
within the preceding year.  Increases, on 7/1/99, mileage
compensation for jurors from 33 to 37 cents.  Appropriates
$69,166 for FY 1999-2000 and $69,166 for FY 2000-2001 for
increased juror compensation.

                   A  BILL  FOR  AN  ACT


 1      SECTION 1.  Section 612-6, Hawaii Revised Statutes, is
 2 amended to read as follows:
 3      "612-6 Exempt when.  [(a)  No person shall be authorized
 4 to claim an exemption from service as a juror in the courts of
 5 the first circuit from January 1, 1989, through December 31,
 6 1990, and in the courts of all circuits, other than the first
 7 circuit from January 1, 1990, through December 31, 1991.
 8      (b)  From January 1, 1991, for the courts of the first
 9 circuit, and from January 1, 1992, for all other circuits of the
10 State, a] A person may claim exemption from service as a juror if
11 the person [is:
12      (1)  An attorney at law;
13      (2)  A head of an executive department, an elected official,
14           or a judge, of the United States, State or county;
15      (3)  A minister or priest following the minister's or
16           priest's profession;
17      (4)  A practicing physician or dentist;
18      (5)  A member of the armed forces or militia when on active
19           service, or an active member of a police or fire
20           department;

 1      (6)  A person who] has served as a juror, either in a court
 2           of this State or the United States District Court for
 3           the District of Hawaii, within one year preceding the
 4           time of filling out the juror qualification form."
 5      SECTION 2.  Section 612-8, Hawaii Revised Statutes, is
 6 amended by amending subsection (a) to read as follows:
 7      "(a)  Each juror shall be paid $30 for each day of actual
 8 attendance at court.  In addition, each juror shall be paid [33]
 9 37 cents for each mile actually and necessarily traveled in going
10 to and from court.  A person who appears at the time for which
11 that person is summoned to court for jury duty may be allowed the
12 mileage fee although the person, upon that person's request, is
13 subsequently excused or exempted from jury service."
14      SECTION 3.  There is appropriated out of the general
15 revenues of the State of Hawaii the sum of $69,166, or so much
16 thereof as may be necessary for fiscal year 1999-2000, and the
17 same sum, or so much thereof as may be necessary for fiscal year
18 2000-2001, for increased juror compensation.  The sums
19 appropriated shall be expended by the judiciary for the purposes
20 of this Act.
21      SECTION 4.  Statutory material to be repealed is bracketed.

 1      SECTION 5.  This Act shall take effect on January 1, 2001;
 2 provided that sections 2 and 3 shall take effect on July 1, 1999.
