                    SENATE  CONCURRENT
                        RESOLUTION
  REQUESTING THE STATE AUDITOR TO CONDUCT A PROGRAM AND FINANCIAL
    AUDIT OF THE DEPARTMENT OF HEALTH'S ADULT MENTAL HEALTH
    DIVISION.


 1        WHEREAS, in 1999, the Department of Health requested an
 2   additional $16,000,000 from the 1999 Legislature, for a total
 3   authorization of $46,000,000, to implement its compliance plan
 4   in United States v. State of Hawaii, et. al., Civil
 5   No. 91-00137 DAE; and
 6   
 7        WHEREAS, the Governor has requested the 2000 Legislature
 8   to appropriate over $14,000,000 in emergency funding for the
 9   Adult Mental Health Division's fiscal year 1999-2000 budget;
10   and
11   
12        WHEREAS, the Governor also has requested an additional
13   $23,300,000 in fiscal year 2000-2001 supplemental funding for
14   adult mental health services; and
15   
16        WHEREAS, as the funding authority for the State, it is
17   appropriate that the Legislature, in complying with its
18   fiduciary responsibility, have available as much information as
19   possible about how the funds are to be spent; now, therefore,
20   
21        BE IT RESOLVED by the Senate of the Twentieth Legislature
22   of the State of Hawaii, Regular Session of 2000, the House of
23   Representatives concurring, that the State Auditor is requested
24   to conduct a program and financial audit of the Department of
25   Health's Adult Mental Health Division; and
26   
27        BE IT FURTHER RESOLVED that the State Auditor's review is
28   requested to include, but not be limited to, the operations of
29   Hawaii State Hospital, the Department of Health's plans to
30   comply with court orders applicable to the Hawaii State
31   Hospital, the availability of appropriate community-based
32   services for the severely mentally ill, and the legislative
33   appropriations for the Adult Mental Health Division; and
34   
35        BE IT FURTHER RESOLVED that the State Auditor is requested
36   to submit the findings of this program and financial audit no
37   later than twenty days prior to the convening of the Regular

 1   Session of 2001; and
 2   
 3        BE IT FURTHER RESOLVED that certified copies of this
 4   Concurrent Resolution be transmitted to the Governor, the
 5   Director of Health, and the State Auditor.
