                    SENATE  CONCURRENT
                        RESOLUTION
  ENCOURAGING THE DEPARTMENT OF EDUCATION TO RELOCATE MAILI
    ELEMENTARY SCHOOL TO A SAFER, HEALTHIER LOCATION.


 1        WHEREAS, there should be equity and excellence for all
 2   students in Hawaii public schools and an environment that is
 3   conducive to learning; and
 4   
 5        WHEREAS, Maili elementary is situated in an
 6   environmentally threatening locale -  mauka of Kiyabu Chicken
 7   Farm, a large chicken farm averaging 50,000 chickens; the
 8   Inafuku chicken farm; and the Medeiros house lots used for
 9   raising ducks, peacocks, horses, pigs, and cattle; and
10   
11        WHEREAS, Maili Elementary's close proximity to these farms
12   has resulted in a number of environmental problems for
13   students, including infestation of insects, disease-carrying
14   flies from the nearby farms' animal waste; contaminated air
15   from the manure, and litter due to public use of the school
16   grounds; and contaminated soil caused by sewage backing up in
17   the flood zone area where the school is located; and
18   
19        WHEREAS, as a result of the use of pesticides and other
20   chemicals by the nearby farms, there are a number of
21   significant health concerns for students attending Maili
22   Elementary; and
23   
24        WHEREAS, these substandard conditions present a tremendous
25   impediment to the education of students attending Maili
26   Elementary and create many health problems incurred by staff
27   such as sinus infections, congestion, headaches, asthma,
28   respiratory problems, allergies, ear infections, and skin
29   problems.  These health conditions have resulted in teachers
30   and a principal transferring to another school.  Those teachers
31   and staff who are susceptible can develop severe health
32   problems due to the dust, stench, and heat in the school
33   environment; and
34   
35        WHEREAS, Maili Elementary's environmental conditions
36   represent a health hazard to many of the students, teachers,
37   and administrators.  Students complain of being thirsty,
38   sleepy, and dizzy due to the heat and complain of breathing bad
39   air; and

 1        WHEREAS, inspection by the department of health indicated
 2   that dust, odors, and vectors from the adjacent farmlands and
 3   high temperatures may be affecting faculty and students of the
 4   school and recommended air conditioning to prevent dust and
 5   vectors from entering the classrooms and a general maintenance
 6   program to keep classrooms clean, but no such program has been
 7   implemented and would only serve as a temporary solution to the
 8   larger environmental problem at Maili Elementary; now,
 9   therefore,
10   
11      BE IT RESOLVED by the Senate of the Twentieth Legislature of
12 the State of Hawaii, Regular Session of 2000, the House of
13 Representatives concurring, that the department of education is
14 encouraged to relocate Maili Elementary to a safer, healthier
15 location so that its students can learn in an environment that is
16 conducive to learning and that fosters pride in their school; and
17 
18      BE IT FURTHER RESOLVED that certified copies of this
19 Concurrent Resolution be transmitted to the Chairperson of the
20 Board of Education and the Superintendent of Education.
