Sir:

     Your Committee on Judiciary and Hawaiian Affairs, to which
was referred H.B. No. 2245, H.D. 1, entitled: 

     "A BILL FOR AN ACT RELATING TO THE HAWAII TOURISM
     AUTHORITY,"

begs leave to report as follows:

     The purpose of this bill is to clarify that marketing and
research activities of the Hawaii Tourism Authority (HTA) should
not be subject to environmental review.

     Testimony in support of this bill was submitted by the
Department of Business, Economic Development, and Tourism, the
HTA, the Hawaii Hotel Association, and the Land Use Research
Foundation.  The Chamber of Commerce of Hawaii and the Maui
Economic Development Board testified in support of the intent of
the bill. 

     Testimony in opposition to this bill was submitted by
Hawaii's Thousand Friends, the Hawaiian Environmental Coalition,
Na Leo Pohai, the Office of Hawaiian Affairs, the Sierra Club,
Hawai`i Chapter, and the University of Hawai`i Environmental
Center.    

     Your Committee finds that marketing and research activities
of the HTA should not be subject to environmental review.

     Your Committee has amended this bill by:

     (1)  Deleting the phrase "to state the parameters of chapter
          343" from the last sentence in the findings and purpose
          section of the bill; and

     (2)  Adding a new section to address the partial exemption
          of the HTA from the environmental impact statement law.

     As affirmed by the record of votes of the members of your
Committee on Judiciary and Hawaiian Affairs that is attached to
this report, your Committee is in accord with the intent and
purpose of H.B. No. 2245, H.D. 1, as amended herein, and
recommends that it pass Third Reading in the form attached hereto
as H.B. No. 2245, H.D. 2.
