Sir:

     Your Committee on Water and Land Use, to which was referred
H.B. No. 2379 entitled: 

     "A BILL FOR AN ACT RELATING TO LANDOWNERS' LIABILITY,"

begs leave to report as follows:

     The purpose of this bill is to redefine "land" to exclude
land which is open to the public for commercial purposes.

     Testimony in support of this bill was received from Bob
Toyofuku on behalf of the Consumer Lawyers of Hawaii.

     No testimony in opposition to the bill was received.

     Your committee finds that "land" does not include land open
to the public for commercial purposes.

     As affirmed by the record of votes of the members of your
Committee on Water and Land Use that is attached to this report,
your Committee is in accord with the intent and purpose of H.B.
No. 2379 and recommends that it pass Second Reading and be
