Sir:

     Your Committee on Energy and Environmental Protection, to
which was referred S.B. No. 2885 entitled: 

     "A BILL FOR AN ACT RELATING TO SANITATION,"

begs leave to report as follows:

     The purpose of this bill is to repeal statutes dealing with
Department of Health (DOH) responsibilities as to:

     (1)  The location and sanitary conditions of businesses; and

     (2)  Dwellings and lodging houses.

     The DOH testified in support of this measure.

     Your Committee finds that the laws to be repealed are not
used by the DOH as other sections of the Hawaii Revised Statutes
provide adequate authority for the DOH to carry out its necessary
functions in protecting the public's health interests.

     As affirmed by the record of votes of the members of your
Committee on Energy and Environmental Protection that is attached
to this report, your Committee is in accord with the intent and
purpose of S.B. No. 2885 and recommends that it pass Second
Reading and be placed on the calendar for Third Reading.
