A BILL FOR AN ACT

 

relating to kaalaea stream.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that Kaalaea stream is susceptible to flooding and currently has an erosion problem. Due to erosion of the stream, some property owners have experienced the loss of or damage to part of their property. In addition, past flooding threatened the Kaalaea stream bridge at Kamehameha highway. The purpose of this Act is to direct the department of land and natural resources to study the flooding problems of Kaalaea stream and to create a flood control plan.

SECTION 2. The department of land and natural resources is directed to study the extent of flooding in Kaalaea stream and to create a flood control plan. The department shall report findings and recommendations to the legislature no later than twenty days prior to the start of the Regular Session of 2002.

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $500,000, or so much thereof as may be necessary for fiscal year 2001-2002, for the preparation of a flood control plan for Kaalaea stream.

SECTION 4. The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

SECTION 5. This Act shall take effect on July 1, 2001.
