A BILL FOR AN ACT

 

relating to the employees' retirement system.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that full-time employees who work on a temporary basis during the legislative session for more than ninety calendar days have been denied the benefits available from the employees' retirement system. This is true despite the inclusion of "legislative employees who are employed on a full-time basis during and between sessions," in the definition of "employee" for purposes of retirement benefits provided in chapter 88, Hawaii Revised Statutes. The purpose of this Act is to ensure that all administrative steps necessary to include these employees in the employees' retirement system will occur.

SECTION 2. The house of representatives and the senate shall take all necessary steps to ensure that full-time employees who work on a temporary basis during the legislative session for more than ninety calendar days without a break in service, are enrolled in the employees' retirement system to the extent authorized by law and that all necessary employer contributions are also included. The department of accounting and general services is directed to assist the respective payroll and accounting staff of the house of representatives and the senate to fully implement this Act.

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $ , or so much thereof as may be necessary for fiscal year 2001-2002, for the inclusion of full-time legislative employees in the employees' retirement system.

SECTION 4. The sum appropriated shall be expended by the legislature for the purposes of this Act. This appropriation shall not lapse until June 30, 2___.

SECTION 5. This Act, upon its approval, shall take effect retroactive to January 1, 19___; provided that sections 3 and 4 shall take effect on July 1, 2001.
