A BILL FOR AN ACT

 

relating to nonimmigrant students.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A- Nonimmigrant alien secondary school students. (a) The department shall not award a high school diploma, or its adult equivalent, to a nonimmigrant alien unless the nonimmigrant alien has reimbursed the department for the full, unsubsidized per capita cost of providing the nonimmigrant alien with a public education, for the period of the nonimmigrant alien's attendance in a public school.

(b) For the purposes of this section only, "alien" means any person not a citizen or national of the United States.

(c) This section shall not apply to the immediate family and household members of a nonimmigrant alien who has been granted a diplomatic visa."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
