A BILL FOR AN ACT
relating to private correctional facilities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 353, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§353- Private correctional facilities. (a) Notwithstanding any law to the contrary, no individual, corporation, partnership, association, or any other private entity may authorize, construct, own, or operate any type of correctional facility for the confinement of inmates serving sentences for violation of the laws of a jurisdiction other than Hawaii. No person charged or convicted in another state or charged or convicted in federal court in another state may be confined in a private correctional facility in this State.
(b) No individual, corporation, partnership, association, or any other private entity may:
(1) Construct a private correctional facility in this State unless authorized by the department of public safety pursuant to rules adopted by the department pursuant to chapter 91; or
(2) Own a private correctional facility in this State."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
